{"id":10694,"date":"2015-11-30T14:12:35","date_gmt":"2015-11-30T14:12:35","guid":{"rendered":"http:\/\/www.ispreview.co.uk\/?p=10694"},"modified":"2015-11-30T14:12:35","modified_gmt":"2015-11-30T14:12:35","slug":"ofcom-slap-bt-for-missing-data-on-regulatory-financial-statements","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2015\/11\/ofcom-slap-bt-for-missing-data-on-regulatory-financial-statements.html","title":{"rendered":"Ofcom Slap BT for Missing Info on Regulatory Financial Statements"},"content":{"rendered":"<p>The national UK telecoms regulator has ruled that they have &#8220;<em>reasonable grounds<\/em>&#8221; for believing that <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> contravened 13A.8 and 8A.8 of their Significant Market Power (SMP) conditions, which means that the operator has not provided all of the information that it is required to supply.<\/p>\n<p><!--more--><\/p>\n<p>The rules essentially require <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> to prepare and publish a &#8220;<em>reconciliation report which sets out changes to the Regulatory Accounting Methodology and the impact of such changes on the Regulatory Financial Statements, and Material Errors corrected in the Regulatory Financial Statements and the impact of such Material Errors<\/em>&#8221; on their Regulatory Financial Statements.<\/p>\n<p><a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> deems <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> to have SMP in the United Kingdom and imposes a number of strict regulator controls on the operator, but keeping track of every change isn\u2019t easy. In this case BT is required to publish the related reconciliation report and a corresponding audit opinion within 4 months of the financial year to which they relate, but apparently the operator has been a bit slow to do this.<\/p>\n<blockquote class=\"bq1\"><p><strong>Ofcoms Statement<\/strong><\/p>\n<p>&#8220;<em><a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> notes BT\u2019s reasons for delay in preparing the reconciliation report and corresponding audit opinion, and its intention to publish both by 4 December 2015. We also note the various arguments BT put forward in mitigation. Having considered BT\u2019s representations, however, we take the view that BT was required to publish those documents on 31 July 2015. On this basis, we are satisfied that BT has contravened, and is continuing to contravene, SMP conditions 13A.8(vi) and 8A.8(vi).<\/em><\/p>\n<p><em><a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> has therefore issued a decision under section 96C of the Act (a \u201cConfirmation Decision\u201d) confirming the imposition of requirements in accordance with the Notification. This means that, in order to comply with the requirements of SMP conditions 13A.8(vi) and 8A.8(vi) and to remedy the consequences of the contravention, BT must publish the reconciliation reports and corresponding audit opinions forthwith, and in any event no later than 4 December 2015<\/em>.&#8221;<\/p><\/blockquote>\n<p>In the grander scheme of things this is not a big breach and you can read the latest update on Ofcom&#8217;s website (<a href=\"http:\/\/stakeholders.ofcom.org.uk\/enforcement\/competition-bulletins\/open-cases\/all-open-cases\/cw_01171\/\">here<\/a>).
