{"id":1089,"date":"2012-06-20T07:35:55","date_gmt":"2012-06-20T06:35:55","guid":{"rendered":"http:\/\/www.ispreview.co.uk\/?p=1089"},"modified":"2012-06-20T07:35:55","modified_gmt":"2012-06-20T06:35:55","slug":"bt-becomes-last-big-uk-broadband-isp-block-the-pirate-bay-website","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2012\/06\/bt-becomes-last-big-uk-broadband-isp-block-the-pirate-bay-website.html","title":{"rendered":"BT Becomes Last Big UK Broadband ISP to Block The Pirate Bay Website"},"content":{"rendered":"<p><a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> yesterday become the last of the big UK based broadband ISPs to block <strong>The Pirate Bay<\/strong> website following a <strong>court order<\/strong>, which has been preceded by identical moves from <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/bskyb\" rel=\"nofollow\" target=\"_blank\">Sky Broadband<\/a>, Everything Everywhere (Orange UK and T-Mobile), <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/tt\" rel=\"nofollow\" target=\"_blank\">TalkTalk<\/a>, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/o2uk\" rel=\"nofollow\" target=\"_blank\">O2<\/a>, BE Broadband and <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/vm\" rel=\"nofollow\" target=\"_blank\">Virgin Media<\/a>. But what comes next?<\/p>\n<p><!--more--><\/p>\n<p>The <a href=\"http:\/\/www.bpi.co.uk\" target=\"_new\">British Phonographic Industry<\/a> (BPI), which represents the UK recorded music industry, originally called upon ISPs to &#8220;<em>voluntarily<\/em>&#8221; block the website (<a href=\"http:\/\/www.ispreview.co.uk\/story\/2011\/11\/05\/music-rights-holders-strong-arm-uk-isp-bt-to-block-the-pirate-bay-website.html\" target=\"_blank\">here<\/a>) after earlier using a similar court order to strong arm them into censorship of the <strong>Newzbin<\/strong> website (<a href=\"http:\/\/www.ispreview.co.uk\/story\/2011\/07\/28\/court-ruling-forces-uk-isp-bt-to-block-piracy-websites-for-the-mpa.html\" target=\"_blank\">here<\/a>). At the time <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> refused and warned that a &#8220;<em>court order will be needed before any blocking could begin<\/em>&#8220;.<\/p>\n<p>In February 20120 Rights Holders were able to successfully use <strong>Section 97A<\/strong> of the <strong>Copyright, Designs and Patents Act<\/strong> (<a href=\"http:\/\/www.ispreview.co.uk\/story\/2012\/02\/20\/high-court-ruling-puts-uk-isps-on-the-path-to-blocking-the-pirate-bay-website.html\" target=\"_blank\">here<\/a>), which had previously worked in the Newzbin case, to identify that The Pirate Bay site was being used for rampant <strong>internet piracy<\/strong>. As a result the <strong>High Court of Justice<\/strong> (London) has been gradually imposing a court ordered block against the site (<a href=\"http:\/\/www.ispreview.co.uk\/index.php\/2012\/04\/high-court-forces-more-uk-isps-to-block-the-pirate-bay-p2p-website.html\" target=\"_blank\">here<\/a>).<\/p>\n<blockquote class=\"bq1\"><p><strong>Judge Justice Arnold said (Feb 2012):<\/strong><\/p>\n<p>&#8220;<em>In my judgment, the operators of [The Pirate Bay] do authorise its users&#8217; infringing acts of copying and communication to the public. They go far beyond merely enabling or assisting. I conclude that both users and the operators of [The Pirate Bay] infringe the copyrights of the claimants &#8230; in the UK.<\/em><\/p>\n<p><em>Despite their ability to do so and despite the judicial findings that have been made against them, the operators of [The Pirate Bay] take no steps to prevent infringement. On the contrary &#8230; they actively encourage it and treat any attempts to prevent it (judicial or otherwise) with contempt<\/em>.&#8221;<\/p><\/blockquote>\n<p>As pointed out on multiple occasions and in our recent article \u2013 <a href=\"http:\/\/www.ispreview.co.uk\/index.php\/2012\/04\/how-to-keep-your-data-private-and-browse-the-internet-anonymously.html\" target=\"_blank\">How to Keep Your Data Private and Browse the Internet Anonymously<\/a> \u2013 ISPs do not actually have any real control over content that exists on remote servers (the internet), thus any blocks are usually skin deep and <strong>easy to circumvent<\/strong> (VPN, Proxy Servers etc.). It&#8217;s akin to putting a &#8220;<em>Do Not Enter<\/em>&#8221; sign outside an open and unguarded door. Not to mention that the high publicity blocking campaign has also made people more aware of the sites.<\/p>\n<p>Similar censorship measures now look set to become increasingly common, with the government still pursuing a <strong>voluntary code<\/strong> to make imposing such restrictions both quicker and more cost effective for rights holders (<a href=\"http:\/\/www.ispreview.co.uk\/story\/2011\/06\/21\/rights-holders-and-uk-isps-close-in-on-voluntary-website-blocking-code.html\" target=\"_blank\">here<\/a>). This has been in development for over a year, held up by cost concerns and the need for an <strong>impartial judge<\/strong> to asses each case (i.e. to prevent legal retaliation by site owners). The system is also said to only focus on a small number (about 100) of &#8220;<em>structurally infringing sites<\/em>&#8221; (i.e. not YouTube etc.).<\/p>\n<p>Meanwhile it remains unclear whether or not Right Holders will choose to pursue any additional sites through the court system.
