{"id":1115,"date":"2012-06-25T07:21:30","date_gmt":"2012-06-25T06:21:30","guid":{"rendered":"http:\/\/www.ispreview.co.uk\/?p=1115"},"modified":"2012-06-25T07:25:18","modified_gmt":"2012-06-25T06:25:18","slug":"competition-commission-stops-bt-linking-broadband-pension-charges","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2012\/06\/competition-commission-stops-bt-linking-broadband-pension-charges.html","title":{"rendered":"UK Competition Commission Stop BT Linking Broadband to Pension Payments"},"content":{"rendered":"<p>The <a href=\"http:\/\/www.competition-commission.org.uk\" target=\"_blank\">Competition Commission<\/a> (CC) has quietly ruled in <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a>&#8217;s favour by preventing <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> from including wholesale broadband charges into its <strong>deficit repair payments<\/strong>, which could have forced rival ISPs to pay tens of millions of pounds more in order to help pay down the operators <strong>\u00a39bn pension deficit<\/strong>.<\/p>\n<p><!--more--><\/p>\n<p>Deficit repair payments represent the cash amounts that <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> pays to reduce the deficit in the company&#8217;s pension fund. So far <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> has repeatedly ruled that neither deficit repair payments, nor pension &#8220;<em>holidays<\/em>&#8220;, should be taken into account when <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> sets <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a>&#8217;s regulated charges (<a href=\"http:\/\/www.ispreview.co.uk\/story\/2010\/07\/23\/ofcom-proposes-not-to-link-bt-pensions-to-wholesale-broadband-charges.html\" target=\"_blank\">2010 Pension Ruling<\/a>).<\/p>\n<p>According to the <a href=\"http:\/\/www.ft.com\/cms\/s\/0\/67b1955e-bc9e-11e1-a470-00144feabdc0.html#axzz1ymTSMQEW\" target=\"_blank\">FT<\/a>, BT last year challenged Ofcom&#8217;s ruling and ultimately managed to secure the Competition Commission&#8217;s interest. But it&#8217;s understood that both <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/bskyb\" rel=\"nofollow\" target=\"_blank\">Sky Broadband<\/a> and <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/tt\" rel=\"nofollow\" target=\"_blank\">TalkTalk<\/a>, which would have been adversely affected by any decision that favoured BT, intervened with the support of an independent pensions consultant, <strong>John Ralfe<\/strong>, whom was allegedly able to show that the pension deficit occurred as a result of BT&#8217;s own commercial decisions.<\/p>\n<blockquote class=\"bq1\"><p><strong>A BT Spokesperson said:<\/strong><\/p>\n<p>&#8220;<em>Although the Competition Commission agreed with BT on a number of points, it ultimately concluded that Ofcom had not erred in how it applied its regulatory judgment<\/em>.&#8221;<\/p><\/blockquote>\n<p>Ofcom said at the end of 2010 that predictability and consistency were important for creating an environment where BT and its wholesale customers could invest, which would have been less attractive had the regulator forced rivals to shoulder more of BT&#8217;s own pension deficit costs.
