{"id":12597,"date":"2016-09-30T10:39:58","date_gmt":"2016-09-30T09:39:58","guid":{"rendered":"http:\/\/www.ispreview.co.uk\/?p=12597"},"modified":"2016-09-30T11:34:04","modified_gmt":"2016-09-30T10:34:04","slug":"ofcom-enforces-new-uk-business-broadband-speed-code-practice","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2016\/09\/ofcom-enforces-new-uk-business-broadband-speed-code-practice.html","title":{"rendered":"Ofcom Enforces New UK Business Broadband Speed Code of Practice"},"content":{"rendered":"<p>The communications regulator has today started to enforce their new business-focused Voluntary Code of Practice for Broadband Speeds, which aims to provide UK businesses with more accurate and reliable information on what line speeds they should expect from member ISPs.<\/p>\n<p><!--more--><\/p>\n<p>The <strong><a href=\"http:\/\/stakeholders.ofcom.org.uk\/binaries\/telecoms\/cop\/bb\/business_broadband_code_2016.pdf\" target=\"_blank\">new code<\/a><\/strong>, which is largely a mirror of <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a>&#8217;s similar residential policy (<a href=\"http:\/\/www.ispreview.co.uk\/new\/complain\/common_isp_complaints_speed.php\">here<\/a>), was first announced at the very start of this year (<a href=\"http:\/\/www.ispreview.co.uk\/index.php\/2016\/01\/ofcom-uk-introduces-new-business-broadband-speed-code-of-practice.html\">here<\/a>) and is being supported by <a href=\"http:\/\/www.awin1.com\/cread.php?awinmid=3042&amp;awinaffid=110483&amp;clickref=btbnews&amp;p=http:\/\/business.bt.com\/packages\/\" target=\"_blank\">BT Business<\/a>, Daisy Communications, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/kcom\" rel=\"nofollow\" target=\"_blank\">KCOM<\/a>, <a href=\"http:\/\/www.awin1.com\/awclick.php?mid=5865&amp;id=110483\" target=\"_blank\">TalkTalk Business<\/a>, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/vm\" rel=\"nofollow\" target=\"_blank\">Virgin Media<\/a>, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/xln\" rel=\"nofollow\" target=\"_blank\">XLN Telecom<\/a> and <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/zen_internet\" target=\"_blank\">Zen Internet<\/a>; these ISPs provide services to around two thirds of SMEs who have &#8220;<em>standard broadband<\/em>&#8221; (i.e. <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/adsl\">ADSL<\/a>, Cable and <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttc\">FTTC<\/a>).<\/p>\n<p>In simple terms the code requires business ISPs to provide more accurate estimates of connection performance (DOWNLOAD and UPLOAD speeds) and to help resolve related problems when they arise. Business customers will also be allowed to exit their contract at any point if speeds &#8220;<em>fall below a minimum guaranteed level<\/em>&#8220;, without penalty.<\/p>\n<p>For example, a small business that buys a package advertised as being &#8216;up to&#8217; 17Mbps (Megabits per second) might then be given a personalised estimated speed range of 11.3Mbps to 15.6Mbps and also a <strong>Minimum Guaranteed Speed<\/strong> (MGS) for their specific line of 7Mbps. But if the speed falls below 7Mbps and the ISP cannot resolve it then they&#8217;d be able to exit the contract.<\/p>\n<blockquote><p><span style=\"color: #339966;\"><strong>Member ISPs Commit to..<\/strong><\/span><\/p>\n<p>* Provide businesses with an accurate estimate of their expected speeds before signing up (this covers both download and upload speeds).<\/p>\n<p>* Manage their business customers\u2019 speed-related problems effectively.<\/p>\n<p>* Offer them the right to exit their contract without penalty if speeds fall below the minimum guaranteed level.<\/p>\n<p>* Give additional relevant speeds information at the point of sale (e.g. how the ISP manages Internet traffic on its network, and how this might affect a customer\u2019s speed).<\/p>\n<p>* Provide further detailed speeds information in writing to the customer after the sale.<\/p><\/blockquote>\n<p>The new rule could be painful for some business ISP services, which often employ longer contract terms (e.g. 24 months+) and tend to cost more than home broadband deals. Mind you any ISPs with a concern can simply choose to ignore the code because it\u2019s not mandatory.<\/p>\n<blockquote class=\"bq1\"><p><strong>Lindsey Fussell, Director of <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a>&#8217;s Consumer Group, said:<\/strong><\/p>\n<p>&#8220;<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a>&#8217;s job is to make sure that everyone across the UK is getting the best possible communications services. We are concerned that too many businesses are not receiving the broadband speeds they expect when they sign their contract.<\/p>\n<p>So broadband companies have agreed to give clear and accurate information on speeds upfront so business customers can make more informed decisions. We&#8217;ve also made it easier for businesses to walk away from their broadband contract without penalty if speeds fall below the levels guaranteed by their provider.&#8221;<\/p><\/blockquote>\n<blockquote class=\"bq1\"><p><strong>Mike Cherry, National Chairman for the FSB, said:<\/strong><\/p>\n<p>&#8220;A broadband service that small businesses can rely on is essential for a modern business. It\u2019s impossible to underestimate how much this matters to small business owners, whose sales and customer relations so often rely on a stable connection. FSB members are clear about their need for clear and accurate information about both the download and upload speeds they can expect at the point of sale.<\/p>\n<p>The new Code of Practice coming into effect this week is a timely and well targeted intervention in the business broadband market by Ofcom which FSB is pleased to support. With more accurate and transparent information at the point of sale, small businesses right across the UK will be able to make better decisions. The ability to walk away from a contract if speeds fall below guaranteed levels will be especially welcomed by business owners.&#8221;<\/p><\/blockquote>\n<p>We should add that the code itself &#8220;<em>applies to all businesses, regardless of size, and to all <span style=\"text-decoration: underline;\">standard business broadband<\/span> services across all technologies<\/em>&#8221; (this includes <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttc\">FTTC<\/a>, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/adsl\">ADSL<\/a>, Cable and <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttp\">FTTP<\/a>). However the &#8220;<em>right to exit<\/em>&#8221; (contract) clause of the Code is technology specific and does not apply to Cable (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/vm\" rel=\"nofollow\" target=\"_blank\">Virgin Media<\/a>) or <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttp\">FTTP<\/a> connections.<\/p>\n<p>On top of that the code itself does not apply to technologies and services where speeds are guaranteed and\/or the customer has a dedicated connection, as in those cases the speeds achieved by the services are clear to business customers at point of sale (e.g. Ethernet first mile (EFM), Ethernet over <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttc\">FTTC<\/a> (EoFTTC) and Leased Lines).<\/p>\n<p>Apparently the reason for <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttp\">FTTP<\/a> and Cable connections being excluded from the &#8220;<em>right to exit<\/em>&#8221; clause is, using Ofcom&#8217;s words, &#8220;<em>because by the very nature of the technology used, speed performance is less variable<\/em>&#8220;. The regulator may be correct, although this neglects the fact that network congestion and other capacity \/ traffic management related issues can still impact performance.<\/p>\n<p>Another problem, as expressed by Adrian Kennard (MD of AAISP), is that Ofcom &#8220;<em>have not enforced that the wholesale carriers, which most ISPs use, provide the same guarantee to the ISPs. As such, no ISP using a wholesale carrier like <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> Wholesale, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/vodafoneuk\" rel=\"nofollow\" target=\"_blank\">Vodafone<\/a> or Talk Talk could possibly offer this speed code of practice without risk of finding themselves with no means to actually fulfill it, and losing out as a consequence<\/em>.&#8221;<\/p>\n<p><strong>UPDATE 11:30am<\/strong><\/p>\n<p>As an addition to Adrian&#8217;s remark above, we&#8217;ve been informed that <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/vodafoneuk\" rel=\"nofollow\" target=\"_blank\">Vodafone<\/a>&#8217;s Wholesale products actually do comply with the new code, which is an interesting development.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The communications regulator has today started to enforce their new business-focused Voluntary Code of Practice for Broadband Speeds, which aims to provide UK businesses with more accurate and reliable information on what line speeds they should expect from member ISPs.<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"ngg_post_thumbnail":0,"footnotes":""},"categories":[1],"tags":[472,36],"class_list":["post-12597","post","type-post","status-publish","format-standard","hentry","category-uk_isp_news","tag-business","tag-ofcom-regulation"],"share_on_mastodon":{"url":"","error":""},"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.9 -
