{"id":13210,"date":"2017-01-05T10:06:32","date_gmt":"2017-01-05T10:06:32","guid":{"rendered":"http:\/\/www.ispreview.co.uk\/?p=13210"},"modified":"2017-01-06T06:48:36","modified_gmt":"2017-01-06T06:48:36","slug":"three-uk-accused-charging-vat-contract-cancellations","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2017\/01\/three-uk-accused-charging-vat-contract-cancellations.html","title":{"rendered":"Three UK Accused of Overcharging for VAT on Contract Cancellations"},"content":{"rendered":"<p><a class=\"shortlink shortlink-133 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\" rel=\"\" title=\"ofcom\" data-chref=\"https:\/\/www.ofcom.org.uk\">Ofcom<\/a> has begun an unofficial probe after mobile operator <a class=\"shortlink shortlink-80\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/threeuk\" target=\"_blank\" rel=\"nofollow\" title=\"three uk\">Three UK<\/a> was accused of &#8220;<em>ripping off<\/em>&#8221; subscribers who choose to cancel their contracts early, which it allegedly does by failing to fully deduct 20% of Value Added Tax (VAT) from the remaining months of service rental.<!--more--><\/p>\n<p>According to <a class=\"shortlink shortlink-80\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/threeuk\" target=\"_blank\" rel=\"nofollow\" title=\"three uk\">Three UK<\/a>&#8217;s Terms &amp; Conditions (<a href=\"http:\/\/www.three.co.uk\/termspdf\/Essential_Plans_PriceGuide_221216.pdf\" target=\"_blank\">here<\/a>), the cancellation fee works as follows: &#8220;<em>Lump sum equivalent to the total of all the monthly charges still remaining during the minimum term of your agreement less a discount of: (i) 3% for new connecting customers who are in the first minimum term of their agreement with us; or (ii) 10% for existing customers that have upgraded or renewed their existing contract with us for a further, subsequent minimum term<\/em>.&#8221;<\/p>\n<p>In other words, you pay a total lump sum to reflect the remaining months of your contract and a small discount of 3-10% may also be applied. The problem is that Three UK appears to have applied VAT to some or all of those remaining months (bills) for a number of subscribers, but generally VAT should only be applied to services rendered and as such if you&#8217;re no longer receiving the service itself then it&#8217;s supposed to be deducted.<\/p>\n<p>The other major mobile network operators (<a class=\"shortlink shortlink-68\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/o2uk\" target=\"_blank\" rel=\"nofollow\" title=\"o2\">O2<\/a>, <a class=\"shortlink shortlink-43\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/eebroadband\" target=\"_blank\" rel=\"nofollow\" title=\"ee home broadband\">EE<\/a> and <a class=\"shortlink shortlink-90\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/vodafoneuk\" target=\"_blank\" rel=\"nofollow\" title=\"vodafone\">Vodafone<\/a>) all automatically deduct VAT from any remaining months (e.g. a service that cost \u00a320 inc. VAT per month becomes \u00a316.67 +vat). However this may only apply to the service rental, while VAT should still be applied to other outstanding payments or the handset (i.e. &#8220;<em>additional goods or services<\/em>&#8220;); such as if you took out a service and handset bundle.<\/p>\n<p>However an investigation by <strong>Michael Green<\/strong>, a Cambridge law graduate and founder of <strong>CaseHub<\/strong>, has alleged via <a href=\"http:\/\/www.thisismoney.co.uk\/money\/news\/article-4085830\/The-great-mobile-scam-Three-rips-customers-end-contract.html\" target=\"_blank\">This is Money<\/a> that Three UK doesn&#8217;t always appear to be deducting VAT properly from its cancellation charges. The operator denies that it charges VAT on cancellation fees, although they&#8217;ve yet to explain the discrepancies observed on related bills.<\/p>\n<blockquote class=\"bq1\"><p><strong>A Spokesperson for Three UK said:<\/strong><\/p>\n<p>&#8220;The way we calculate early termination fees is clearly set out to customers when they join us and is available in our price guide and terms and conditions&#8221;<\/p><\/blockquote>\n<blockquote class=\"bq1\"><p><strong>A Spokesperson for <a class=\"shortlink shortlink-133 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\" rel=\"\" title=\"ofcom\" data-chref=\"https:\/\/www.ofcom.org.uk\">Ofcom<\/a> said:<\/strong><\/p>\n<p>&#8220;It\u2019s important people wishing to leave their mobile contracts early are fairly treated.
