{"id":14991,"date":"2017-11-23T07:54:48","date_gmt":"2017-11-23T07:54:48","guid":{"rendered":"https:\/\/www.ispreview.co.uk\/?p=14991"},"modified":"2017-11-23T07:54:48","modified_gmt":"2017-11-23T07:54:48","slug":"uk-mobile-operators-win-appeal-vs-2014-radio-spectrum-licence-fee-hike","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2017\/11\/uk-mobile-operators-win-appeal-vs-2014-radio-spectrum-licence-fee-hike.html","title":{"rendered":"UK Mobile Operators Win Appeal vs 2014 Radio Spectrum Licence Fee Hike"},"content":{"rendered":"<p>The UK Court of Appeal has reversed an earlier ruling that found in favour of <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a>&#8217;s proposed hike to annual licence fees for the 900MHz and 1800MHz (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/3g\">3G<\/a> \/ <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/4g\">4G<\/a>) radio spectrum bands, which could have resulted in price rises for consumers and less investment by Mobile Network Operators.<!--more--><\/p>\n<p>The regulator has been trying to impose their hike since 2014, which followed an earlier <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/4g\">4G<\/a> auction of the <strong>800MHz<\/strong> and <strong>2.6GHz<\/strong> (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/4g\">4G<\/a>) bands that arguably failed to raise quite as much money as the Government might have hoped (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2013\/04\/national-audit-office-probes-uk-4g-mobile-spectrum-auction.html\" target=\"_blank\" rel=\"noopener\">here<\/a>). Critics thus suggested that the proposed hike was just a way for the Government to balance its books and it was certainly a significant change (see below).<\/p>\n<p>At around the same time the Government was also trying to nudge operators towards agreeing a new<strong> \u00a35bn<\/strong> deal that would extend geographic network coverage to 90% (<a href=\"http:\/\/www.ispreview.co.uk\/index.php\/2014\/12\/uk-mobile-operators-agree-5bn-deal-extend-geographic-coverage-90.html\" target=\"_blank\" rel=\"noopener\">here<\/a>). Part of that agreement involved asking <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> to look again at the fees, although the regulator had already warned this was &#8220;<em>unlikely to have a material effect<\/em>&#8221; on their proposal and indeed it didn&#8217;t.<\/p>\n<p><img decoding=\"async\" class=\"ngg-singlepic ngg-none\" src=\"https:\/\/www.ispreview.co.uk\/wp-content\/gallery\/2015-article-illustrations\/ofcom_mobile_licence_fees_sept_2015.gif\" alt=\"ofcom mobile licence fees sept 2015\" width=\"100%\" \/><\/p>\n<p>Suffice to say that the mobile operators (e.g. <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/eebroadband\" rel=\"nofollow\" target=\"_blank\">EE<\/a>, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/vodafoneuk\" rel=\"nofollow\" target=\"_blank\">Vodafone<\/a>, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/threeuk\" rel=\"nofollow\" target=\"_blank\">Three UK<\/a> and <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/o2uk\" rel=\"nofollow\" target=\"_blank\">O2<\/a>) weren&#8217;t happy and they attempted to challenge the decision by launching a <strong>Judicial Review<\/strong>, which argued that <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> had wrongly calculated the bills (e.g. they didn\u2019t factor network running costs) and failed to consider the potential impact on future investment in networks.<\/p>\n<p>Unfortunately the Judge, <strong>Mr Justice Cranston<\/strong>, last year ruled that Ofcom&#8217;s approach gave a &#8220;<em>better reflection of market value<\/em>&#8221; than the cost models provided by <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/eebroadband\" rel=\"nofollow\" target=\"_blank\">EE<\/a> and its supporters (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2016\/08\/ee-uk-lose-court-battle-900mhz-1800mhz-licence-fee-hike.html\">here<\/a>). Meanwhile <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/eebroadband\" rel=\"nofollow\" target=\"_blank\">EE<\/a> said that the fees were &#8220;<em>excessive at a time when significant private investment is needed to ensure the UK benefits from first class mobile infrastructure<\/em>&#8221; and promptly launched an appeal.<\/p>\n<p>Yesterday the Court of Appeal in London dramatically found in favour of EE&#8217;s argument. According to the <a href=\"https:\/\/www.ft.com\/content\/6ab98d6a-cf85-11e7-b781-794ce08b24dc\" target=\"_blank\" rel=\"noopener\">FT<\/a> (paywall), the judge ruled that Ofcom&#8217;s annual fee rise was inconsistent with EU laws on infrastructure investment. The court also found that Ofcom had misinterpreted a 2010 instruction from the government that ordered it to review the levy and reflect the fact that the market value of spectrum had risen due to rising Smartphone use.<\/p>\n<p>The HM Treasury has already started collecting the higher fees and if the ruling stands then it could force a repayment to the mobile operators, which could be worth between \u00a3200m to \u00a3300m.<\/p>\n<blockquote class=\"bq1\"><p><strong>A Spokesperson for Ofcom said:<\/strong><\/p>\n<p>&#8220;This case raised an important point of law concerning the government\u2019s spectrum direction to Ofcom. We are considering the judgement carefully.&#8221;<\/p><\/blockquote>\n<p>Naturally EE said they were &#8220;<em>happy<\/em>&#8221; with the decision and have suggested that if the money is returned then it could be invested back into their network. The move is also a big blow to Ofcom, which has somewhat of a patchy history when it comes to settling disputes between warring Mobile Network Operators (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2017\/09\/ee-uk-starts-legal-challenge-stop-cap-3-4ghz-5g-mobile-spectrum.html\">lest we forget the current 5G case<\/a>).<\/p>\n<p>However the battle may not yet be over because the court also gave Ofcom permission to appeal against the decision.
