ETCs apply to customers that choose to exit their contract early.<!--more--><\/p>\n<p>The two General Conditions (GC) in question are <strong>GC9.3<\/strong> and <strong>GC9.2<\/strong>. The GC9.3 rule is designed to &#8220;<em>ensure that the conditions which apply if you terminate your contract don\u2019t disincentivise you from changing to a new provider, e.g. through excessive early termination charges<\/em>,&#8221; while GC9.2 requires providers to make the terms for their ETCs &#8220;<em>clear, comprehensive and easily accessible.<\/em>&#8221;<\/p>\n<blockquote class=\"bq1\"><p><a href=\"https:\/\/www.ofcom.org.uk\/about-ofcom\/latest\/bulletins\/competition-bulletins\/open-cases\/cw_01217\" target=\"_blank\" rel=\"noopener\"><strong>Regulator&#8217;s Statement<\/strong><\/a><\/p>\n<p>The investigation will examine <a class=\"shortlink shortlink-43\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/eebroadband\" target=\"_blank\" rel=\"nofollow\" title=\"ee home broadband\">EE<\/a>\u2019s compliance with GC9.2 and GC9.3, in particular whether:<\/p>\n<p>&#8212; its early termination charges (ETCs) were set out in a clear, comprehensive and easily accessible form; and<br \/>\n&#8212; by not accounting for discounts given to customers on their monthly retail price in its conditions and procedures for calculating ETCs, these ETCs acted as disincentives to customers against changing provider.<\/p><\/blockquote>\n<p>At this stage <a class=\"shortlink shortlink-133 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\" rel=\"\" title=\"ofcom\" data-chref=\"https:\/\/www.ofcom.org.uk\">Ofcom<\/a> are only gathering evidence (until August 2018) and will announce their preliminary findings later this year.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Mobile and broadband provider EE has today become subject to a new probe by the national telecoms regulator.
