{"id":17636,"date":"2018-12-12T11:22:20","date_gmt":"2018-12-12T11:22:20","guid":{"rendered":"https:\/\/www.ispreview.co.uk\/?p=17636"},"modified":"2018-12-12T11:22:32","modified_gmt":"2018-12-12T11:22:32","slug":"vonage-fined-24-5k-by-ofcom-for-failure-of-uk-voip-phone-service","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2018\/12\/vonage-fined-24-5k-by-ofcom-for-failure-of-uk-voip-phone-service.html","title":{"rendered":"Vonage Fined \u00a324.5K by Ofcom for Failure of UK VoIP Phone Service"},"content":{"rendered":"<p>An investigation into the availability of <a href=\"https:\/\/www.vonage.com\/\" target=\"_blank\" rel=\"noopener\">Vonage<\/a>&#8216;s internet phone (<a class=\"shortlink shortlink-106 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/voip\" target=\"_blank\" rel=\"\" title=\"voip\" data-chref=\"https:\/\/www.ispreview.co.uk\/jargon\/jargon_detail.php?VoIP---Voice-over-IP-98\">VoIP<\/a>) service has resulted in <a class=\"shortlink shortlink-133 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\" rel=\"\" title=\"ofcom\" data-chref=\"https:\/\/www.ofcom.org.uk\">Ofcom<\/a> imposing a \u00a324,500 penalty on the provider, which came after they discovered that the company had &#8220;<em>failed to provide uninterrupted access<\/em>&#8221; to the emergency services (999 or 112 for police, fire etc.).<!--more--><\/p>\n<p>The regulator&#8217;s <strong>General Condition 3.1<\/strong> (GC3.1) rule requires communication providers to &#8220;<em>take all necessary measures to maintain, to the greatest extent possible (a) the proper and effective functioning of the public communications network at all times (b) in the event of catastrophic network breakdown or in cases of force majeure the fullest availability of the public communications network and telephone services and (c) uninterrupted access to emergency organisations for their end-users<\/em>.&#8221;<\/p>\n<p>On top of that Section 105A(4) of the Communications Act 2003 requires CPs to take all appropriate steps to protect, &#8220;<em>so far as possible<\/em>,&#8221; the availability of the provider\u2019s public electronic communications network. Unfortunately Vonage&#8217;s move in <strong>January 2018<\/strong> to implement &#8220;<em>technical changes<\/em>&#8221; to the way calls were routed on its network ended up briefly disrupting access to the emergency services.<\/p>\n<p>In the end <a class=\"shortlink shortlink-133 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\" rel=\"\" title=\"ofcom\" data-chref=\"https:\/\/www.ofcom.org.uk\">Ofcom<\/a> blamed this on a &#8220;<em>failure to complete emergency call testing,<\/em>&#8221; which would have identified the problem.<\/p>\n<blockquote class=\"bq1\"><p><a href=\"https:\/\/www.ofcom.org.uk\/about-ofcom\/latest\/bulletins\/competition-bulletins\/all-closed-cases\/cw_01216\" target=\"_blank\" rel=\"noopener\"><strong>Ofcom Statement<\/strong><\/a><\/p>\n<p>Although the company carried out testing to ensure that regular calls were still being connected during the transition, it failed to test the emergency call numbers, 999 and 112, as part of this process. Vonage therefore failed to identify that emergency calls were not connecting successfully following the routing changes it had made.<\/p>\n<p>Our investigation concluded that Vonage had broken our rules, which require communications providers to maintain uninterrupted access to the emergency services.<\/p>\n<p>We have imposed a penalty of \u00a324,500 on the company. This figure includes a 30% discount as a result of Vonage admitting liability and agreeing to settle the case. The penalty will be paid to HM Paymaster General.<\/p><\/blockquote>\n<p>Vonage has since made changes to its network and testing processes to minimise the risk of a similar incident occurring in future. The outcome helps to highlight the growing importance of Voice-over-<a class=\"shortlink shortlink-105 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ip\" target=\"_blank\" rel=\"\" title=\"internet protocol address\" data-chref=\"https:\/\/www.ispreview.co.uk\/jargon\/jargon_detail.php?IP---Internet-Protocol-42\">IP<\/a> (<a class=\"shortlink shortlink-106 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/voip\" target=\"_blank\" rel=\"\" title=\"voip\" data-chref=\"https:\/\/www.ispreview.co.uk\/jargon\/jargon_detail.php?VoIP---Voice-over-IP-98\">VoIP<\/a>) service stability, which is becoming more essential as UK broadband ISP users increasingly switch away from traditional phone line services.<\/p>\n<p>Both <a class=\"shortlink shortlink-80\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/threeuk\" target=\"_blank\" rel=\"nofollow\" title=\"three uk\">Three UK<\/a> and <a class=\"shortlink shortlink-69\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/kcom\" target=\"_blank\" rel=\"nofollow\" title=\"kcom\">KCOM<\/a> were last year also hit with fines (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2017\/06\/ofcom-fines-three-uk-1-89m-drop-access-emergency-services.html\">here<\/a> and <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2017\/08\/kcom-fined-900000-ofcom-emergency-services-network-failure.html\">here<\/a>) after network problems, such as a major outage, meant they were similarly unable to provide some or all of their customers with access to the emergency services.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>An investigation into the availability of Vonage&#8216;s internet phone (VoIP) service has resulted in Ofcom imposing a \u00a324,500 penalty on the provider, which came after they discovered that the company had &#8220;failed to provide uninterrupted access&#8221; to the emergency services (999 or 112 for police, fire etc.).<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"ngg_post_thumbnail":0,"footnotes":""},"categories":[1],"tags":[36,81],"class_list":["post-17636","post","type-post","status-publish","format-standard","hentry","category-uk_isp_news","tag-ofcom-regulation","tag-voip"],"share_on_mastodon":{"url":"","error":""},"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 -
