{"id":18374,"date":"2019-04-04T12:40:25","date_gmt":"2019-04-04T11:40:25","guid":{"rendered":"https:\/\/www.ispreview.co.uk\/?p=18374"},"modified":"2019-04-04T14:37:25","modified_gmt":"2019-04-04T13:37:25","slug":"ofcom-probe-bts-conduct-during-tender-for-n-ireland-psn-contract","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2019\/04\/ofcom-probe-bts-conduct-during-tender-for-n-ireland-psn-contract.html","title":{"rendered":"Ofcom Probe BT&#8217;s Conduct During Tender for N.Ireland PSN Contract"},"content":{"rendered":"<p>The UK communications regulator, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a>, has today opened a new investigation that will examine <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a>&#8217;s conduct during the tender for the recent \u00a350m Northern Ireland Public Sector Shared Network contract, which will consider whether or not the operator kept within the Significant Market Power (SMP) rules.<!--more--><\/p>\n<p>Last year the Department of Finance announced that <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> had won a major new contract &#8211; initially valued at around \u00a350m over 9 years &#8211; to provide connectivity services to public sector organisations in <strong>Northern Ireland<\/strong> via a new <strong>Public Sector Shared Network<\/strong> (NI PSSN). The first core network services are due to be made available by this summer.<\/p>\n<p>However <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> has today launched an investigation to &#8220;<em>consider<\/em>&#8221; whether <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> has correctly complied with the relevant SMP conditions, as set out in their Fixed Access Market Review 2014 and the Wholesale Local Access Market Review 2018. At the time of writing the regulator hasn&#8217;t offered much detail, although they have outlined which aspects they intend to probe (<a href=\"https:\/\/www.ofcom.org.uk\/about-ofcom\/latest\/bulletins\/competition-bulletins\/open-cases\/cw_01240?utm_medium=email&amp;utm_campaign=Ofcom%20Competition%20and%20Consumer%20Enforcement%20Bulletin%20BT&amp;utm_content=Ofcom%20Competition%20and%20Consumer%20Enforcement%20Bulletin%20BT+CID_2dd23c41fa115f31dec7969446db18dc&amp;utm_source=updates&amp;utm_term=Investigation%20into%20BTs%20conduct%20during%20the%20tender%20of%20the%20NIPSSN%20contract\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>).<\/p>\n<blockquote><p><span style=\"color: #339966;\"><strong>Specifically, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> will consider:<\/strong><\/span><\/p>\n<ul>\n<li>Whether BT provided network access on reasonable request and on fair and reasonable terms, conditions and charges as required by SMP condition 1;<\/li>\n<li>Whether BT unduly discriminated against other communications providers as prohibited by SMP condition 4; and\/or<\/li>\n<li>Whether BT provided network access on an Equivalence of Inputs basis as required by SMP condition 5.<\/li>\n<\/ul>\n<\/blockquote>\n<p>We should point out that BT Enterprise won the contract and <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/openreach\" target=\"_blank\">Openreach<\/a> are supplying them.<\/p>\n<blockquote class=\"bq1\"><p><strong>A Spokesperson for <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/openreach\" target=\"_blank\">Openreach<\/a> told ISPreview.co.uk:<\/strong><\/p>\n<p>&#8220;We are aware of Ofcom\u2019s investigation and we will, of course, provide any information they require in the course of their enquiries.&#8221;<\/p><\/blockquote>\n<p>End.<\/p>\n<p><strong>UPDATE 2:36pm<\/strong><\/p>\n<p>Updated to add <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/openreach\" target=\"_blank\">Openreach<\/a>&#8217;s quote and clarify the company relationships.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The UK communications regulator, Ofcom, has today opened a new investigation that will examine BT&#8217;s conduct during the tender for the recent \u00a350m Northern Ireland Public Sector Shared Network contract, which will consider whether or not the operator kept within the Significant Market Power (SMP) rules.<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"ngg_post_thumbnail":0,"footnotes":""},"categories":[1],"tags":[474,472,478,414,36],"class_list":["post-18374","post","type-post","status-publish","format-standard","hentry","category-uk_isp_news","tag-bt","tag-business","tag-ethernet","tag-northern-ireland","tag-ofcom-regulation"],"share_on_mastodon":{"url":"","error":""},"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v28.6 -
