{"id":18869,"date":"2019-06-24T11:39:05","date_gmt":"2019-06-24T10:39:05","guid":{"rendered":"https:\/\/www.ispreview.co.uk\/?p=18869"},"modified":"2019-06-24T11:39:05","modified_gmt":"2019-06-24T10:39:05","slug":"ico-fines-uk-mobile-operator-ee-100k-for-spamming-customers","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2019\/06\/ico-fines-uk-mobile-operator-ee-100k-for-spamming-customers.html","title":{"rendered":"ICO Fines UK Mobile Operator EE \u00a3100k for SPAMMING Customers"},"content":{"rendered":"<p>The <a href=\"https:\/\/ico.org.uk\" target=\"_blank\" rel=\"noopener noreferrer\">Information Commissioners Office<\/a> (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ico\" target=\"_blank\">ICO<\/a>) has today imposed a \u00a3100,000 fine on <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a>-owned mobile operator <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/eebroadband\" rel=\"nofollow\" target=\"_blank\">EE<\/a> after the company sent over 2.5 million direct marketing messages (texts) to its customers during early 2019, albeit without gaining their consent to do so.<!--more--><\/p>\n<p>The messages encouraged customers to access and use the &#8220;<em>My <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/eebroadband\" rel=\"nofollow\" target=\"_blank\">EE<\/a><\/em>&#8221; app in order to manage their account and also to upgrade their phone, while a second batch of messages was sent afterwards to customers who had not engaged with the first. Overall 16.6 million messages were sent but 2.72 million of the recipients had previously opted-out of receiving marketing messages (not all of these texts were received, hence why the final total is 2.5m).<\/p>\n<p>In response <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/eebroadband\" rel=\"nofollow\" target=\"_blank\">EE<\/a> claimed that such messages were exempt from the marketing rules because they were merely &#8220;<em>service messages<\/em>,&#8221; although the <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ico\" target=\"_blank\">ICO<\/a> &#8220;<em>found the messages contained direct marketing and that the company sent them deliberately, although acknowledges that EE did not deliberately set out to breach electronic marketing laws<\/em>.&#8221;<\/p>\n<p>Under the rules marketing messages can be only sent to existing customers if they have given their consent and if they are given a simple way to opt-out of marketing when their details are first collected and in every message sent. People have a right to opt out of receiving marketing at any time, at which point it&#8217;s the organisation\u2019s responsibility to stop sending them.<\/p>\n<blockquote class=\"bq1\"><p><strong>Andy White, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ico\" target=\"_blank\">ICO<\/a> Director of Investigations, said:<\/strong><\/p>\n<p>&#8220;These were marketing messages which promoted the company\u2019s products and services. The direct marketing guidance is clear: if a message that contains customer service information also includes promotional material to buy extra products for services, it is no longer a service message and electronic marketing rules apply.<\/p>\n<p>EE Limited were aware of the law and should have known that they needed customers\u2019 consent to send them in line with the direct marketing rules.
