{"id":21465,"date":"2020-03-12T10:44:41","date_gmt":"2020-03-12T10:44:41","guid":{"rendered":"https:\/\/www.ispreview.co.uk\/?p=21465"},"modified":"2020-03-12T11:54:16","modified_gmt":"2020-03-12T11:54:16","slug":"ofcom-hit-bt-uk-with-245k-fine-for-overcharging-on-118-calls","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2020\/03\/ofcom-hit-bt-uk-with-245k-fine-for-overcharging-on-118-calls.html","title":{"rendered":"Ofcom Hit BT UK with \u00a3245K Fine for Overcharging on 118 Calls"},"content":{"rendered":"<p>Last year&#8217;s confession by <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> that they had failed to immediately apply <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a>&#8217;s new price cap on UK calls to 118 numbers (Directory Enquiries) until June 2019 (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2019\/06\/mobile-operator-ee-coughs-to-being-late-with-118-price-cap.html\">here<\/a>), which resulted in several thousand of <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/eebroadband\" rel=\"nofollow\" target=\"_blank\">EE<\/a>&#8217;s mobile customers being overcharged, has resulted in the operator being fined \u00a3245,000.<!--more--><\/p>\n<p>Today the popularity of the internet means that only a few people still use 118 numbers. Nevertheless <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> last year noted that some operators of such services were charging as much as \u00a320 for a 90 second call and so they decided to take action. The regulator capped the maximum cost that a 118 service can charge at \u00a33.65 per 90 seconds and this was enforced from 1st April 2019 (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2019\/04\/new-cost-cap-on-uk-calls-to-118-directory-enquiries-goes-live.html\">here<\/a>).<\/p>\n<p>However it wasn&#8217;t long before <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> informed <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> that &#8220;<em>it did not apply this cap to calls made by a number of its <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/eebroadband\" rel=\"nofollow\" target=\"_blank\">EE<\/a> customers to 118 numbers until mid-April 2019<\/em>&#8221; (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2019\/06\/mobile-operator-ee-coughs-to-being-late-with-118-price-cap.html\">here<\/a>), although today&#8217;s announcement found that almost <strong>6,000 customers<\/strong> were affected between a wider three month period from 1st April and 26th June 2019. The overcharge itself amounted to a total of \u00a342,000.<\/p>\n<p>The good news is that <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> were able to correct most bills before <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/eebroadband\" rel=\"nofollow\" target=\"_blank\">EE<\/a> customers paid them, which meant that only around \u00a310,000 of the total amount overcharged was actually paid by their subscribers. All customers have since been refunded.<\/p>\n<blockquote class=\"bq1\"><p><a href=\"https:\/\/www.ofcom.org.uk\/about-ofcom\/latest\/bulletins\/competition-bulletins\/all-closed-cases\/cw_01242\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Ofcom Statement<\/strong><\/a><\/p>\n<p>BT&#8217;s failure to implement the 118 price cap was a serious breach of our rules, particularly taking into account the potentially vulnerable people that use directory enquiry services. So we have imposed a penalty of \u00a3245,000 on BT. The penalty includes a 30% discount in recognition that BT admitted its failings by agreeing to settle the case.<\/p><\/blockquote>\n<blockquote class=\"bq1\"><p><strong>An EE Spokesperson said:<\/strong><\/p>\n<p>&#8220;We apologise for any inconvenience that this mistake caused to a very small number of our customers. Customers that were affected were overcharged by less than \u00a35 on average and we quickly contacted and refunded every one of them.
