The move could result in further delays for the <strong>Digital Economy Act<\/strong> (DEAct).<\/p>\n<p><!--more--><\/p>\n<p><a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> published its revised <a href=\"http:\/\/www.ispreview.co.uk\/index.php\/2012\/06\/ofcom-release-internet-piracy-tackling-initial-obligations-code-for-uk-isps.html\" target=\"_blank\">Initial Obligations Code<\/a>, which describes how and when internet providers should issue <strong>Notifications Letters<\/strong> (internet piracy warning notices) to their customers, and the related <a href=\"http:\/\/stakeholders.ofcom.org.uk\/consultations\/infringement-implementation\/\" target=\"_blank\">Sharing of Costs Order<\/a> in June last year. At the time it was envisaged that the first letters would be sent during <strong>early 2014<\/strong>.<\/p>\n<p>However, according to <a href=\"http:\/\/www.pcpro.co.uk\/news\/broadband\/379735\/anti-piracy-letter-plans-face-delay-over-costs\" target=\"_blank\">PC Pro<\/a> and the <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/org\" target=\"_blank\">Open Rights Group<\/a> (ORG), the already once revised Sharing of Costs Order has now been withdrawn because HM Treasury &#8220;<em>need to make technical changes<\/em>&#8221; in order to ensure that the legislation can meet the departments &#8220;<em>Managing Public Money<\/em>&#8221; guidelines.<\/p>\n<blockquote class=\"bq1\"><p><strong>Peter Bradwell, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/org\" target=\"_blank\">Open Rights Group<\/a>, said:<\/strong><\/p>\n<p>&#8220;<em><a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> is spending hefty amounts of public money, which ultimately would be paid back by copyright owners participating in the scheme. The government maintains the issue now is technical compliance with the guidelines.<\/em><\/p>\n<p><em>The exact reasons are not clear. But the fact that <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> is stumping up many millions of pounds with apparently no clear commitment from copyright owners about who will pay it back, and when, could be part of the problem<\/em>.&#8221;<\/p><\/blockquote>\n<p>The order itself requires ISPs to pay only around a quarter of the costs. Rights Holders would bear all of the costs incurred by Ofcom, the majority of costs incurred by the appeals body, and 75% of the costs &#8220;<em>efficiently and reasonably incurred by Qualifying ISPs<\/em>&#8221; (i.e. only the biggest broadband ISPs) in carrying out their obligations. It also sets out the structure for the <strong>\u00a320 fee for appeals<\/strong> by ISP subscribers.<\/p>\n<p>The costs order is a key piece of legislation and its withdrawal means that the legislation must, yet again, be redrafted and <strong>resubmitted to parliament<\/strong>.
