{"id":27242,"date":"2021-06-04T11:09:55","date_gmt":"2021-06-04T10:09:55","guid":{"rendered":"https:\/\/www.ispreview.co.uk\/?p=27242"},"modified":"2021-06-04T11:11:06","modified_gmt":"2021-06-04T10:11:06","slug":"ofcom-accuse-met-technologies-and-guaranteed-telecom-of-slamming","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2021\/06\/ofcom-accuse-met-technologies-and-guaranteed-telecom-of-slamming.html","title":{"rendered":"Ofcom Accuse Met Technologies and Guaranteed Telecom of SLAMMING"},"content":{"rendered":"<p>After a long investigation, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> claims to have found &#8220;<em>reasonable grounds for believing<\/em>&#8221; that two little-known UK broadband ISPs &#8211; <a href=\"http:\/\/www.met-technologies.co.uk\/\" target=\"_blank\" rel=\"noopener noreferrer\">Met Technologies<\/a> (Met Plus Telecom and Millenium Talk) and <a href=\"https:\/\/www.guaranteedtelecom.co.uk\/\" target=\"_blank\" rel=\"noopener noreferrer\">Guaranteed Telecom<\/a> (Zoom Telecom) &#8211; may have switched a number of consumers to their service without permission (SLAMMING).<!--more--><\/p>\n<p>The practice of <strong>SLAMMING<\/strong> is a mis-selling tactic that can occur when naughty people or ISPs trigger a switch (migration) of your service to another provider, albeit without you ever having given confirmed consent. <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a>&#8217;s existing migration rules are designed to protect against such abuse, but they&#8217;re far from perfect.<\/p>\n<p>Back in 2019 <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> published a <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2019\/11\/isps-met-technologies-and-millenium-talk-probed-over-slamming.html\">brief statement<\/a> on the aforementioned case, which said: &#8220;<em>Specifically, this investigation is examining whether these companies have engaged in slamming by placing transfer orders, including repeat transfer orders, for switching customers\u2019 communication services without their express knowledge and\/or consent<\/em>.&#8221; Sadly, no further information was released.<\/p>\n<p>At the time a quick Google around revealed a number of related complaints against the providers (some examples <a href=\"https:\/\/uk.trustpilot.com\/review\/www.metplustelecom.co.uk\">here<\/a> and <a href=\"https:\/\/repdigger.com\/reviews\/guaranteed-telecom-uk\">here<\/a>) and one of them &#8211; Guaranteed Telecom &#8211; even managed to get on the bad side of the <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/bbc\" target=\"_blank\">BBC<\/a>&#8217;s Technology Correspondent, Rory Cellan-Jones, after they targeted one of his elderly relatives (<a href=\"https:\/\/twitter.com\/ruskin147\/status\/1094944490404630528\" target=\"_blank\" rel=\"noopener\">here<\/a>).<\/p>\n<p>Ofcom has now concluded their provisional investigation and found &#8220;<em>reasonable grounds for believing<\/em>&#8221; that both operators may have broken their consumer protection rules between 1st January 2019 to 31st December 2019.<\/p>\n<blockquote class=\"bq1\"><p><strong>Ofcom Statement<\/strong><\/p>\n<p>Specifically, Ofcom has reasonable grounds for believing that Guaranteed Telecom and Met Technologies contravened:<\/p>\n<p>\u27a4 GC C7.3(a), by placing transfer orders, including repeat transfer orders, for customers\u2019 communications services without their express knowledge and\/or consent;<\/p>\n<p>\u27a4 GC C7.7, by failing to create and keep individually retrievable direct Records of Consent for the provision of communications services, for the required minimum period of twelve months; and<\/p>\n<p>\u27a4 GC C7.14(a), by using Cancel Other (a mechanism that losing providers can use in specific situations to cancel a request to transfer a customer) in a way that is not prescribed in the accompanying Annex 1 to GC C7,<\/p><\/blockquote>\n<p>Both operators have now been invited to respond to Ofcom&#8217;s findings before they issue a final decision.
