{"id":27460,"date":"2021-06-23T11:41:13","date_gmt":"2021-06-23T10:41:13","guid":{"rendered":"https:\/\/www.ispreview.co.uk\/?p=27460"},"modified":"2021-06-23T11:43:59","modified_gmt":"2021-06-23T10:43:59","slug":"ofcom-grumbles-at-bt-over-inaccurate-ee-broadband-uso-data","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2021\/06\/ofcom-grumbles-at-bt-over-inaccurate-ee-broadband-uso-data.html","title":{"rendered":"Ofcom Grumbles at BT Over Inaccurate EE Broadband USO Data"},"content":{"rendered":"<p>A probe by the UK telecoms regulator, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a>, has found &#8220;<em>reasonable grounds for believing<\/em>&#8221; that <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> broke the rules by providing &#8220;<em>inaccurate information<\/em>&#8221; in response to a statutory information request, which was seeking data about <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/eebroadband\" rel=\"nofollow\" target=\"_blank\">EE<\/a>&#8217;s Fixed Wireless Access (FWA) broadband service for the <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2019\/12\/connected-nations-2019-3-million-uk-premises-can-get-full-fibre.html\" target=\"_blank\" rel=\"noopener\">2019 Connected Nations<\/a> report.<!--more--><\/p>\n<p>The investigation, which was opened in March 2020 (i.e. it took longer than usual due to COVID-19), centred around <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a>&#8217;s final September 2019 request for <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> to provide (among other things) data on FWA network coverage in the United Kingdom.<\/p>\n<p>The data was intended to be used in their 2019CN report to help estimate the number of premises which would be potentially eligible to receive a 10Mbps+ broadband service under the <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2020\/03\/10mbps-uk-broadband-universal-service-obligation-to-go-live.html\">Universal Service Obligation<\/a> (USO). The 2019CN report was published in December 2019, but it appears as if the data may not have been entirely accurate.<\/p>\n<p>As a result of receiving new information provided by <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a>, on 18th March 2020 <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> found itself having to publish an updated report containing &#8220;<em>corrected estimates<\/em>&#8220;. The new data did not have any real impact on the implementation of the Broadband USO, which also went live in March 2020, but Ofcom&#8217;s rules do still require operators to &#8220;<em>provide complete and accurate information upon request<\/em>.&#8221;<\/p>\n<blockquote class=\"bq1\"><p><a href=\"https:\/\/www.ofcom.org.uk\/about-ofcom\/latest\/bulletins\/competition-bulletins\/open-cases\/cw_01253\" target=\"_blank\" rel=\"noopener\"><strong>Ofcom&#8217;s Statement<\/strong><\/a><\/p>\n<p>We have decided there are reasonable grounds for believing BT has contravened its obligations under section 135 of the Communications Act 2003 (the \u2018Act\u2019) as a result of providing inaccurate information in response to a statutory information request seeking data about <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/eebroadband\" rel=\"nofollow\" target=\"_blank\">EE<\/a>\u2019s Fixed Wireless Access broadband service.<\/p>\n<p>We have issued a provisional notification under section 138 of the Act to BT setting out our reasons for this. BT now has an opportunity to make representations to us on our provisional decision, which we will take into account before we issue a final decision.<\/p><\/blockquote>\n<p>On the face of it, this sounds like a fairly minor issue and probably isn&#8217;t going to attract a particularly big punishment from Ofcom. We should add that the closest service that <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/eebroadband\" rel=\"nofollow\" target=\"_blank\">EE<\/a> offers to a true FWA product is their <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/4g\">4G<\/a> based Mobile Broadband package for home users, which can be installed alongside an external antenna.
