{"id":29316,"date":"2021-11-23T00:01:12","date_gmt":"2021-11-23T00:01:12","guid":{"rendered":"https:\/\/www.ispreview.co.uk\/?p=29316"},"modified":"2021-11-22T11:58:45","modified_gmt":"2021-11-22T11:58:45","slug":"swish-fibre-complain-to-asa-over-bts-use-of-fibre-broadband-terminology","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2021\/11\/swish-fibre-complain-to-asa-over-bts-use-of-fibre-broadband-terminology.html","title":{"rendered":"Swish Fibre Complain to ASA Over BT&#8217;s Use of Fibre Broadband Terminology"},"content":{"rendered":"<p>Alternative UK ISP <a href=\"https:\/\/www.swishfibre.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Swish Fibre<\/a> has continued their &#8220;<em>fake fibre<\/em>&#8221; related advertising feud with <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> today after they lodged a retaliatory complaint with the <a class=\"shortlink shortlink-125 shortlink-chref\" title=\"advertising standards authority\" href=\"https:\/\/www.asa.org.uk\" target=\"_blank\" rel=\"noopener\" data-chref=\"https:\/\/www.asa.org.uk\">Advertising Standards Authority<\/a> (ASA), which objected to the &#8220;<em>confusing<\/em>&#8221; use of the term &#8220;<em>fibre broadband<\/em>&#8221; in the incumbents marketing for their &#8220;<em>part-fibre<\/em>&#8221; (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttc\">FTTC<\/a>) products.<!--more--><\/p>\n<p>The situation began in July 2021, after Swish launched a new advertising campaign (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2021\/07\/swish-fibre-campaign-targets-fake-fibre-uk-broadband-isps.html\">here<\/a>), which saw them place a number of billboard posters around the country (see top). The posters &#8220;<em>playfully<\/em>&#8221; tried to set their own full fibre broadband service apart by using the &#8220;<em>Fake Fibre<\/em>&#8221; phrase to call out significantly slower and less reliable part-fibre services (e.g. <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttc\">FTTC<\/a> \/ <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/vdsl\">VDSL2<\/a>), which still use slow copper lines to connect homes from a street cabinet.<\/p>\n<div class=\"bq2\"><strong>NOTE:<\/strong> Swish (Fern Trading) is investing \u00a3225m+ to build a 10Gbps capable Fibre-to-the-Premiss (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttp\">FTTP<\/a>) broadband network to cover 250,000 premises in the Home Counties (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2021\/05\/swish-fibre-begins-full-fibre-build-in-more-of-the-home-counties.html\">here)<\/a>.<\/div>\n<p>However, Swish&#8217;s original campaign didn&#8217;t do a great job of defining &#8220;<em>Fake Fibre<\/em>&#8220;, which we previously remarked could still make it difficult for regular consumers to understand the differences. As a result, some people may incorrectly end up viewing the term as extending to rival <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttp\">FTTP<\/a> ISPs too. On top of that, it ignored that some hybrid fibre networks (e.g. <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/vm\" rel=\"nofollow\" target=\"_blank\">Virgin Media<\/a> and FTTB ISPs) can deliver gigabit speeds. All of this risked creating more confusion.<\/p>\n<p>In response, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> lodged a complaint with the ASA to challenge Swish\u2019s adverts (this is ongoing), which it perhaps did partly in the knowledge that the advertising watchdog had long resisted &#8211; quite successfully &#8211; attempts to change the situation around the use of &#8220;<em>fibre broadband<\/em>&#8221; terminology in adverts for slower hybrid fibre products (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2019\/04\/cityfibre-lose-case-against-misleading-fibre-broadband-isp-ads.html\">here<\/a>).<\/p>\n<p>Sensing an opportunity, Swish then comically responded by launching a new take on their poster campaign, which introduced the word &#8220;<em>Censored<\/em>&#8221; (see below) as a way of alluding to <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a>&#8217;s resistance to its earlier &#8220;<em>Fake Fibre<\/em>&#8221; messaging.<\/p>\n<p><img decoding=\"async\" class=\"ngg-singlepic ngg-none\" style=\"padding: 0px; width: 100%; border-radius: 4px;\" src=\"https:\/\/www.ispreview.co.uk\/wp-content\/gallery\/2021-article-illustrations\/Swish-Fibre-Censored-Advert.jpg\" alt=\"Swish-Fibre-Censored-Advert\"><\/p>\n<p>Now Swish has opted to take their dispute further and has lodged their own complaint against BT&#8217;s use of &#8220;<em>fibre broadband<\/em>&#8221; on <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttc\">FTTC<\/a> products with the ASA, which they note is often also referenced using similar terminology &#8211; &#8220;<em>Superfast Fibre Broadband<\/em>&#8220;, &#8220;<em>Ultrafast Fibre Broadband<\/em>&#8221; and &#8220;<em>Faster Fibre broadband<\/em>&#8220;, amongst others.<\/p>\n<p>Back in 2017, fellow alternative network provider <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/cityfibre\" target=\"_blank\">CityFibre<\/a> challenged the ASA on this matter, but the case was dismissed by the courts. However, Swish points out that the market has changed dramatically since then and is now rapidly turning to <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttp\">FTTP<\/a> methods, thus the ISP claims to be &#8220;<em>rekindling the fight by pledging to educate the nation on Fake Fibre once and for all and [to] reverse years of misleading advertising<\/em>.&#8221;<\/p>\n<blockquote class=\"bq1\"><p><strong>Alistair Goulden, CMO &amp; Director of Swish Fibre, told ISPreview.co.uk:<\/strong><\/p>\n<p>&#8220;When BT use the word fibre to describe their copper-fibre FTTC networks, I say that you can\u2019t call a vegan sandwich a vegan sandwich if it\u2019s got 10% or even just 1% meat in it. Copper reliant FTTC networks cannot provide download speeds much above 80 Mbps and upload speeds of 20 Mbps. In contrast, full fibre\u2019s 100% fibre-optic cables have the capability to offer up to 10,000Mbps today and potentially even faster download and upload speeds in the future.<\/p>\n<p>It\u2019s time for major industry reform around how we talk about broadband with consumers in the UK. We should be channelling all our efforts into championing Full Fibre and powering the UK up the world broadband speed rankings to help the UK economy recover post pandemic.&#8221;<\/p><\/blockquote>\n<p>The focus here is clearly on FTTC (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/vdsl\">VDSL2<\/a>), which is perhaps to avoid the murky waters of conflict around gigabit-capable FTTB and Hybrid Fibre Coax <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/docsis\">DOCSIS<\/a> 3.1 networks. But the mention of download speeds maxing out at 80Mbps does overlook that <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/gfast\">G.fast<\/a> is also an FTTC style technology and can max out at 330Mbps download and 50Mbps upload, albeit only in ideal circumstances on <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/openreach\" target=\"_blank\">Openreach<\/a>&#8217;s network.<\/p>\n<p>Despite this, Swish claims there is now increasing evidence that consumers &#8220;<em>struggle to differentiate between part-fibre broadband and state of the art full fibre broadband<\/em>,&#8221; such as the recent WIK Consult report for <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/cityfibre\" target=\"_blank\">CityFibre<\/a>. WIK\u2019s study found that 52% of respondents claimed to have a Full Fibre service, despite only 20% of respondents living in areas where that was available at the time.<\/p>\n<p>A recent report from the <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2021\/06\/gigatag-tells-uk-gov-how-to-boost-gigabit-broadband-adoption.html\"><strong>Gigabit Take-Up Advisory Group<\/strong><\/a> (GigaTAG) also warned about similar confusion and called for it to be addressed via a new labelling system (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2021\/06\/gigatag-tells-uk-gov-how-to-boost-gigabit-broadband-adoption.html\">here<\/a>), although the Government has yet to fully respond to the report&#8217;s recommendations. This was seen as important given the Government&#8217;s new <strong>\u00a35bn Project Gigabit<\/strong> initiative, which could suffer if strong take-up doesn&#8217;t follow deployment.<\/p>\n<p>Win or lose, all of this will perhaps partly be seen as another clever way of generating publicity for Swish Fibre&#8217;s build.
