{"id":29508,"date":"2021-12-08T14:36:10","date_gmt":"2021-12-08T14:36:10","guid":{"rendered":"https:\/\/www.ispreview.co.uk\/?p=29508"},"modified":"2021-12-14T15:03:49","modified_gmt":"2021-12-14T15:03:49","slug":"cityfibre-start-legal-fight-over-ofcom-approval-of-openreach-fttp-price-cut","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2021\/12\/cityfibre-start-legal-fight-over-ofcom-approval-of-openreach-fttp-price-cut.html","title":{"rendered":"CityFibre Start Legal Fight Over Ofcom Approval of Openreach FTTP Price Cut UPDATE2"},"content":{"rendered":"<p><a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/cityfibre\" target=\"_blank\">CityFibre<\/a> has this week carried out their earlier threats by launching an appeal via the <a href=\"https:\/\/www.catribunal.org.uk\/cases\/14263321-cityfibre-limited\" target=\"_blank\" rel=\"noopener\">Competition Appeal Tribunal<\/a> (CAT) to challenge <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a>&#8217;s recent approval of <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/openreach\" target=\"_blank\">Openreach<\/a>&#8217;s \u201c<em>Equinox<\/em>\u201d offer (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2021\/09\/rivals-sigh-as-ofcom-clear-openreach-fttp-broadband-price-cut.html\">here<\/a>), which introduced a &#8220;<em>major<\/em>&#8221; price cut (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2021\/07\/openreach-unveil-major-fttp-pricing-offer-for-uk-broadband-isps.html\">details<\/a>) to the incumbents Fibre-to-the-Premises (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttp\">FTTP<\/a>) broadband products for UK ISPs.<!--more--><\/p>\n<p>Our readers may recall that the &#8220;<em>Equinox<\/em>&#8221; discount, which was introduced on 1st October 2021, generated an <strong><a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2021\/08\/openreach-rivals-warn-ofcom-not-to-allow-big-fibre-price-cut.html\">angry response<\/a><\/strong> from alternative network (AltNet) providers, including <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/vm\" rel=\"nofollow\" target=\"_blank\">Virgin Media<\/a> (VMO2). Many of those providers are busy investing billions (collectively) to deploy rival <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttp\">FTTP<\/a> networks (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2020\/04\/summary-of-full-fibre-build-progress-across-uk-broadband-isps.html\"><strong>Summary of UK Full Fibre Builds<\/strong><\/a>) and some will build in the same areas as <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/openreach\" target=\"_blank\">Openreach<\/a>, or be overbuilt by them in the future, and sell their own rival wholesale products to ISPs.<\/p>\n<div class=\"bq2\"><strong>NOTE:<\/strong> The offer could, for example, drop the monthly wholesale rental of a 115Mbps or 1000Mbps consumer <a class=\"shortlink shortlink-110 shortlink-chref\" title=\"fttp\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttp\" target=\"_blank\" rel=\"noopener\" data-chref=\"https:\/\/www.ispreview.co.uk\/broadband_fibre_optic.php\">FTTP<\/a> tier from \u00a317.44 and \u00a331.57, respectively, to just \u00a315.50 and just \u00a322. This excludes all the extras that an ISP must add in order to make the retail price you pay (e.g. 20% VAT, profit margin, service features, capacity etc.).<\/div>\n<p>Such AltNets, many of which are in the early stages of their investment and carrying a lot of risk, have previously warned that the new discounts might ultimately result in a reduction in competitive fibre infrastructure investment and deployment. Further down the road, they fear, this could also reduce choice and innovation, and potentially result in higher prices for consumers (but initially it may result in lower prices via competition).<\/p>\n<p>Previously, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/openreach\" target=\"_blank\">Openreach<\/a>\u2019s <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/fttp\">FTTP<\/a> products have tended to be more expensive, which made it easier for AltNets to grow their take-up by being more aggressive on price, but that will now become harder. The other aspect centres around how the new pricing could make it harder for AltNets with wholesale solutions of their own to attract third-party ISPs to their networks, since they\u2019d have less reason to pick them over Openreach.<\/p>\n<p><a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/cityfibre\" target=\"_blank\">CityFibre<\/a>&#8217;s<strong> Notice of Appeal<\/strong> (NoA) to the CAT noted how <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> accepted in the statement that the associated Order Mix Targets (OMTs) for the offer would, in the short term, impact on some ISPs\u2019 incentives to use altnets in areas where the altnets\u2019 FTTP footprint overlaps with Openreach\u2019s footprint. Nonetheless, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> concluded that the OMTs do not create a potential barrier to using altnets.<\/p>\n<p>In short, the operator states that Ofcom went no further than Question 1 (i.e. &#8220;<em>do the terms of the Equinox Offer potentially create a barrier to using altnets?<\/em>&#8220;) in its analysis, to conclude that the Equinox Offer did not raise competition concerns requiring ex ante intervention.<\/p>\n<blockquote class=\"bq1\"><p><strong><a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/cityfibre\" target=\"_blank\">CityFibre<\/a>&#8217;s Grounds for Appeal<\/strong><\/p>\n<p>1. Ground 1(a): Ofcom\u2019s Overlap Conclusion had no sound evidential foundation and was not a conclusion Ofcom could reasonably draw from the evidence.<\/p>\n<p>2. Ground 1(b): Further or alternatively, Ofcom\u2019s Overlap Conclusion was never put to stakeholders in the ConDoc, in breach of Ofcom\u2019s duties of fair consultation and reasonable enquiry.<\/p>\n<p>3. Ground 2: Ofcom\u2019s Overlap Conclusion does not in any event rationally support the conclusion that OMTs create no potential barrier to using altnets.<\/p><\/blockquote>\n<p>CityFibre are seeking to quash Ofcom&#8217;s conclusion to Question 1 and to direct the regulator to conduct a fuller analysis of the Equinox Offer. Naturally, the operator also wants relief from related costs and any &#8220;<em>such relief as the Tribunal considers appropriate in order to give effect to its judgment<\/em>.&#8221; In addition, CityFibre has invited the Tribunal to use its case management powers to ensure that its appeal is &#8220;<em>conducted with appropriate expedition<\/em>.&#8221;<\/p>\n<p>The CAT has invited any other parties with sufficient interest in the outcome of the proceedings to make a request for permission to intervene in the case, which must be made within the next three weeks (Christmas could make that deadline particularly tedious). A number of other AltNets, such as <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/gigaclear\" rel=\"nofollow\" target=\"_blank\">Gigaclear<\/a>, have previously expressed an interest in joining such action (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2021\/11\/rivals-prep-legal-challenge-over-ofcom-approval-of-openreach-fttp-price-cut.html\">here<\/a>).<\/p>\n<p>The other difficulty here, which may or may not end up being relevant to the case itself &#8211; given how the NoA focuses more on Ofcom&#8217;s procedure, is that we do exist in an aggressively competitive market, especially in urban areas. AltNets thus typically take a big risk in assuming that Openreach wouldn\u2019t adapt or be allowed to adapt to their pricing strategies, particularly in urban areas.<\/p>\n<p>In those competitive areas, Ofcom\u2019s market review had already decided that Openreach shouldn\u2019t face much regulation. This partly also reflected Ofcom\u2019s earlier decision (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2021\/03\/ofcom-unveils-2021-changes-to-boost-uk-full-fibre-broadband.html\">here<\/a>) to give Openreach a \u201c<em>fair bet<\/em>\u201d on FTTP (i.e. softer regulation to help foster deployment), which was promptly followed by an accelerated \u00a315bn commitment to cover 25 million premises by December 2026 (c.80% of the UK).<\/p>\n<p>Typically, legal challenges against regulatory rulings can be long and costly affairs, albeit ones that do sometimes succeed. We&#8217;ll be watching this one closely.<\/p>\n<p><strong>UPDATE 4:17pm<\/strong><\/p>\n<p>We&#8217;ve requested a few comments and got the responses back.<\/p>\n<blockquote class=\"bq1\"><p><strong>An Ofcom spokesperson said:<\/strong><\/p>\n<p>&#8220;We carefully considered this offer and rivals\u2019 views, and concluded that it does not raise concerns requiring intervention.&#8221;<\/p><\/blockquote>\n<blockquote class=\"bq1\"><p><strong>Greg Mesch, CEO of CityFibre, said:<\/strong><\/p>\n<p>&#8220;CityFibre has filed a notice of appeal with the Competition Appeal Tribunal against Ofcom\u2019s decision to take no action regarding Openreach\u2019s Equinox offer.<\/p>\n<p>We consider the decision to be wrong and inconsistent with Ofcom\u2019s policy objective of promoting infrastructure competition by encouraging investment in alternative Full Fibre networks.<\/p>\n<p>As the Equinox offer is already having an adverse impact on competition, we have asked the Tribunal to deal with our appeal quickly so as to remove any market uncertainty.&#8221;<\/p><\/blockquote>\n<p><strong>UPDATE 9th December 2021<\/strong><\/p>\n<p>Openreach&#8217;s comment is below, which was initially placed in the wrong article due to a mistake.<\/p>\n<blockquote class=\"bq1\"><p><strong>An Openreach spokesperson said:<\/strong><\/p>\n<p>&#8220;We agree with Ofcom that our full fibre prices allow other networks to compete fairly with Openreach. Competition\u2019s good for customers, it\u2019s what Openreach exists to promote, and it\u2019s something Government and Ofcom have rightly worked hard to encourage.&#8221;<\/p><\/blockquote>\n<p><strong>UPDATE 14th Dec 2021<\/strong><\/p>\n<p>We&#8217;ve had a late comment from INCA too, which represents UK AltNets.<\/p>\n<blockquote class=\"bq1\"><p><strong>INCA Chief Executive, Malcolm Corbett, said:<\/strong><\/p>\n<p>&#8220;If we are to meet and go beyond the government&#8217;s target for gigabit capable networks we need more competition in the market not less. <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> knows this and is using its market power to reinforce its monopoly position. It wants to deter the competitive investment that has done so much to accelerate the pace of new fibre deployment.<\/p>\n<p>While <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a>\u2019s \u2018Project Equinox\u2019 appears to be about reducing costs to encourage internet service providers to move customers to <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> Openreach\u2019s fibre networks, the actual impact is likely to be a reduction in wholesale competition and that in turn will set back plans, delaying fibre deployment, especially in rural and hard to reach locations.<\/p>\n<p>Ofcom\u2019s decision seems to run directly counter to its stated policy of promoting competitive investment, despite the wide ranging and well-argued case put forward by many industry players at the time.
