{"id":31437,"date":"2022-06-27T09:11:19","date_gmt":"2022-06-27T08:11:19","guid":{"rendered":"https:\/\/www.ispreview.co.uk\/?p=31437"},"modified":"2022-06-28T09:46:21","modified_gmt":"2022-06-28T08:46:21","slug":"government-moves-forward-with-uk-isp-internet-snooping-system","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2022\/06\/government-moves-forward-with-uk-isp-internet-snooping-system.html","title":{"rendered":"Government Moves Forward with UK ISP Internet Snooping System"},"content":{"rendered":"<p>The UK Home Office and the National Crime Agency (NCA) appear to be making progress on the development of a new internet snooping system and database, which could soon require broadband ISPs and mobile operators to provide various agencies with access to view a log of your online activity.<!--more--><\/p>\n<p>In case anybody has forgotten, the <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2016\/11\/controversial-new-uk-internet-snooping-bill-approved-mps.html\" target=\"_blank\" rel=\"noopener noreferrer\">2016 Investigatory Powers Act<\/a> (aka &#8211; &#8220;<em>snoopers charter<\/em>&#8220;) introduced, among many other things, a new power to force ISPs &#8211; upon being ordered to do so by a senior judge &#8211; into logging the <strong>Internet Connection Records<\/strong> (ICR) of all their customers for up to 12 months (e.g. the <a class=\"shortlink shortlink-105 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ip\" target=\"_blank\" rel=\"\" title=\"internet protocol address\" data-chref=\"https:\/\/www.ispreview.co.uk\/jargon\/jargon_detail.php?IP---Internet-Protocol-42\">IP<\/a> addresses of the servers you\u2019ve visited and when), which can be accessed without a warrant and may occur regardless of whether or not you&#8217;re suspected of a crime.<\/p>\n<div class=\"bq2\"><strong>NOTE:<\/strong> Obtaining the &#8216;content&#8217; of a communication (i.e. the message you write) still requires a warrant, but ICRs aren&#8217;t deemed to contain &#8216;content&#8217;.<\/div>\n<p>The <a href=\"https:\/\/assets.publishing.service.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/822817\/Communications_Data_Code_of_Practice.pdf\" target=\"_blank\" rel=\"noopener\"><strong>Communications Data Code of Practice<\/strong><\/a>, which was finalised in 2018, largely indicated that an ICR would &#8220;<em>only identify the service that a customer has been using<\/em>&#8221; and this is likely to involve the retention of various different pieces of data (varying between ISPs\/networks &#8211; depending upon capability).<\/p>\n<p>As we recall, the core ICR data is likely to include a customer&#8217;s account reference, the source <a class=\"shortlink shortlink-105 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ip\" target=\"_blank\" rel=\"\" title=\"internet protocol address\" data-chref=\"https:\/\/www.ispreview.co.uk\/jargon\/jargon_detail.php?IP---Internet-Protocol-42\">IP<\/a> address, destination IP address + port and the date\/time of the start and end of an event or its duration. Tech-savvy users may of course work around this by using a Virtual Private Network (VPN), DNS over HTTPS (DoH), Proxy Servers or various other anonymising tools.<\/p>\n<p>Recent court challenges mean that, technically speaking, such data can only be stored (or ordered to be stored) if it is considered necessary and proportionate to do so, such as in the course of helping to fight serious crime. But the Government\u2019s definition of what is and is not a &#8220;<em>serious<\/em>&#8221; crime has sometimes been called into question. Some of the past court challenges also involved EU courts, but such rulings in post-Brexit land have less sway in the future.<\/p>\n<blockquote><p><span style=\"color: #339966;\"><strong><a href=\"https:\/\/www.gov.uk\/government\/consultations\/investigatory-powers-act-2016-codes-of-practice\/outcome\/communications-data-code-of-practice-accessible-version\" target=\"_blank\" rel=\"noopener\">Extract from the IPAct&#8217;s Comms Data Code<\/a><br \/>\n<\/strong><\/span><\/p>\n<p>For the purposes of Parts 3 and 4 of the Act \u201cserious crime\u201d, defined in section 86(2A) of the Act means: an offence for which an adult is capable of being sentenced to one year or more in prison; any offence involving violence, resulting in a substantial financial gain or involving conduct by a large group of persons in pursuit of a common goal; any offence committed by a body corporate; any offence which involves the sending of a communication or a breach of privacy; or an offence which involves, as an integral part of it, or the sending of a communication or breach of a person\u2019s privacy.<\/p><\/blockquote>\n<h3><span style=\"color: #339966;\"><strong>Progress so far<\/strong><\/span><\/h3>\n<p>Last year we reported that two unnamed broadband or mobile providers (we&#8217;d put good money on <a class=\"shortlink shortlink-145\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" target=\"_blank\" rel=\"nofollow\" title=\"BT\">BT<\/a> being one of those, as a logical choice) had begun early &#8220;<em>small scale<\/em>&#8221; trials of such ICR snooping technology (<a href=\"https:\/\/www.ispreview.co.uk\/index.php\/2021\/03\/two-uk-broadband-isps-trial-new-internet-snooping-system.html\">here<\/a>), which would be the precursor to launching it as a national service for ISPs to adopt.<\/p>\n<p>Sadly, finding out anything further about those trials, as well as the system in general, is difficult because the IPAct effectively prohibits ISPs from talking about it. But this also causes problems for ISPs too, since it&#8217;s much harder for them to share experiences when developing best practices for the code.<\/p>\n<p>However, <a href=\"https:\/\/www.publictechnology.net\/articles\/features\/excl-wall-silence-surrounds-plan-nationwide-collection-citizens%E2%80%99-internet-records\" target=\"_blank\" rel=\"noopener\">Public Technology<\/a> recently uncovered a new <a href=\"https:\/\/www.digitalmarketplace.service.gov.uk\/digital-outcomes-and-specialists\/opportunities\/17267\" target=\"_blank\" rel=\"noopener\"><strong>procurement notice<\/strong><\/a> by the Government&#8217;s <strong>National Communications Data Service<\/strong> (NCDS), which invited firms to develop and provide support for a tool that would allow authorities to search for ICR information and filter results. Five firms (all SMEs) have been selected as potential providers and up to <strong>\u00a32m<\/strong> has been budgeted for the development of the tool and the migration of systems into an AWS environment (i.e. data centre storage provided by <a class=\"shortlink shortlink-137 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/amazon\" target=\"_blank\" rel=\"nofollow\" title=\"amazon\" data-chref=\"https:\/\/www.amazon.co.uk\">Amazon<\/a> Web Services).<\/p>\n<blockquote class=\"bq1\"><p><strong>Extract from the Procurement Notice<\/strong><\/p>\n<p>Under the provisions of the Investigatory Powers (IP) Act, it is now possible for the Law Enforcement Agency (LEA) community to lawfully obtain Internet Connection Records (ICR) in support of their investigations. Following the completion of some initial trial activities, work is now underway to provision a national ICR service. As part of this national service, a central Filtering Arrangement and Results Platform is required, which will be hosted in our NCDS AWS Environment.<\/p>\n<p>To ensure maximum reuse of the trial capabilities, work to evaluate which elements can be migrated to NCDS and which elements need to be rebuilt is ongoing and will be delivered by the existing wider ICR Team. The Technical Migration team (to be sourced under this Outcome) will be responsible for the technical implementation of the national service once this analysis has been completed.<\/p><\/blockquote>\n<p>Work on all this is expected to get underway in July and run for between 6-24 months. The notice states that it is working in line with the expectation that a private Beta version of the &#8216;<em>Filtering Arrangement<\/em>&#8216; and &#8216;<em>Results Platform<\/em>&#8216; capability will be available for use against Telecom Operator (TO) data by the &#8220;<em>end of 2022<\/em>&#8220;.<\/p>\n<p>Still, we&#8217;re sure that all our data will be in good hands as nobody would ever want to abuse a mass national snooping system, no not at all (*tongue firmly in cheek*). As above, getting any kind of official comment on all this is extremely difficult, so we&#8217;re doing our best to fill in the blanks with what we know about the law.<\/p>\n<p>As a side note, ICRs can be accessed by various agencies (local authorities and council officials are NOT permitted to access them), albeit primarily this lot (i.e. not only the police and security services):<\/p>\n<p style=\"padding-left: 40px;\">\u2022 Police and National Crime Agency (NCA)<br \/>\n\u2022 Intelligence agencies: MIS, MI6 and GCHQ<br \/>\n\u2022 HM Revenue and Customs (HMRC)<br \/>\n\u2022 Department of Transport<br \/>\n\u2022 Department for Work and Pensions<br \/>\n\u2022 Serious Fraud Office<br \/>\n\u2022 The Scottish and Welsh Ambulance Service Boards<br \/>\n\u2022 National Health Service (NHS)<br \/>\n\u2022 The Ministry of Defence<br \/>\n\u2022 Department of Health<br \/>\n\u2022 Ministry of Justice<br \/>\n\u2022 Competition and Markets Authority<br \/>\n\u2022 Criminal Cases Review Commission<br \/>\n\u2022 Food Standards Agency<\/p>\n<p>Finally, the code of practice for all this does consider the size of the telecommunications operator, which may affect whether a provider becomes subject to such a data retention notice and what kind of data they will be expected to supply via ICRs.
