{"id":5199,"date":"2014-01-21T12:31:09","date_gmt":"2014-01-21T12:31:09","guid":{"rendered":"http:\/\/www.ispreview.co.uk\/?p=5199"},"modified":"2014-01-21T12:31:09","modified_gmt":"2014-01-21T12:31:09","slug":"uk-isps-bt-talktalk-reject-demand-obstruct-unlicensed-gambling-sites","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2014\/01\/uk-isps-bt-talktalk-reject-demand-obstruct-unlicensed-gambling-sites.html","title":{"rendered":"UK ISPs BT and TalkTalk Reject Demand to Obstruct Unlicensed Gambling Sites"},"content":{"rendered":"<p>The <a href=\"http:\/\/www.gamblingcommission.gov.uk\" target=\"_blank\">Gambling Commission<\/a>, which was set-up under the Gambling Act 2005 to regulate commercial gambling in Great Britain, has been told by two of the country&#8217;s largest broadband ISPs that it will need to seek a court order before they can impede access to unlicensed gambling websites.<\/p>\n<p><!--more--><\/p>\n<p>The reaction, which is similar to how Internet providers tackle websites that are deemed to facilitate piracy (copyright infringement) or depict illegal images (child abuse etc.), follows a request by the Gambling Commission for <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> and <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/tt\" rel=\"nofollow\" target=\"_blank\">TalkTalk<\/a> to put &#8220;<em>warning pages<\/em>&#8221; in front of the unlicensed sites.<\/p>\n<p>Crucially the proposed splash pages would show to everybody and not only those whom have enabled the ISPs <strong>Parental Controls<\/strong>, which by contrast remain an optional system. However the commission has no firm jurisdiction over offshore websites and the Government&#8217;s recent move to tackle such abuses have been criticised for being too weak.<\/p>\n<blockquote class=\"bq1\"><p><strong>A Gambling Commission Spokesperson told the <a href=\"http:\/\/www.ft.com\/cms\/s\/0\/8f261bb0-81db-11e3-a600-00144feab7de.html#axzz2r2A4E9Nf\" target=\"_blank\">FT<\/a>:<\/strong><\/p>\n<p>&#8220;<em>We have been exploring the internet service providers\u2019 approach when faced with clear evidence that sites are unlicensed and engaged in illegal activities. At this stage we are just exploring back-up options as we do not expect illegal sites to be a major issue given the attractiveness and width of the legal offer<\/em>.&#8221;<\/p><\/blockquote>\n<p>Naturally the ISPs complain that it is not their duty to Police the Internet and <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/tt\" rel=\"nofollow\" target=\"_blank\">TalkTalk<\/a> wants to see a &#8220;<em>proper legal framework<\/em>&#8221; put in place, which would apparently need to be like the system for sites that infringe copyright (i.e. Section 97A of the Copyright, Designs and Patents Act).
