{"id":5378,"date":"2014-02-05T09:01:26","date_gmt":"2014-02-05T09:01:26","guid":{"rendered":"http:\/\/www.ispreview.co.uk\/?p=5378"},"modified":"2014-02-05T09:07:58","modified_gmt":"2014-02-05T09:07:58","slug":"uk-telecoms-operators-strangle-ofcom-via-costly-legal-appeals","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2014\/02\/uk-telecoms-operators-strangle-ofcom-via-costly-legal-appeals.html","title":{"rendered":"Big UK Telecoms Operators Strangle Ofcom via Costly Legal Appeals"},"content":{"rendered":"<p><a href=\"http:\/\/www.consumerfutures.org.uk\" target=\"_blank\">Consumer Futures<\/a> (formerly Consumer Focus), which is a Non-Departmental Public Body that was setup to act as a national consumer council, has joined with Which?, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/tt\" rel=\"nofollow\" target=\"_blank\">TalkTalk<\/a> and <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/threeuk\" rel=\"nofollow\" target=\"_blank\">Three UK<\/a> to warn the UK Government that big telecoms and broadband ISPs are harming pro-consumer measures by tying the regulator up with long and costly legal challenges.<\/p>\n<p><!--more--><\/p>\n<p>According to <a href=\"http:\/\/www.theguardian.com\/media\/2014\/feb\/05\/ofcom-decisions-too-easily-derailed-companies\" target=\"_blank\">The Guardian<\/a>, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> has faced<strong> 61 appeals<\/strong> over the last 5 years (fighting these cases can allegedly cost between \u00a32m and \u00a34.5m a year) and nearly all of its rulings have been challenged through the <strong>Competition Appeals Tribunal<\/strong> (CAT); often after complaints by lawyers acting on behalf of the big telecoms operators.<\/p>\n<p>Readers might recall that last year\u2019s auction of <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/4g\">4G<\/a> based Mobile Broadband spectrum (<strong>800MHz<\/strong> and <strong>2.6GHz<\/strong>) was plagued by years of legal challenges, threats and other complexities that ultimately forced the UK into being a late adopter.<\/p>\n<p>The recent moves to <strong>improve switching<\/strong> (migration) between broadband and phone providers has also faced a similar mix of concerns and now won&#8217;t be ready until <strong>June 2015<\/strong>, although in fairness the proposals have suffered due to complex cost and technical challenges that will affect all ISPs; both big and small alike.<\/p>\n<blockquote class=\"bq1\"><p><strong>Consumer Futures Letter Extract<\/strong><\/p>\n<p>&#8220;<em>There are significant concerns that under the current regime, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a>&#8217;s decisions can be derailed too easily, through technical challenges that ignore the substance of the regulator&#8217;s judgments. The routine use of legal challenges has had a chilling effect on policy. It diverts time and money into legal disputes and away from good regulation. This is bad news for competition, for the industry, and for consumers<\/em>.&#8221;<\/p><\/blockquote>\n<p>The move appears designed to support and encourage on-going efforts by the Government, which is working to make it harder for TV operators, telecoms and broadband ISPs to object to <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a>&#8217;s decisions on mere technicalities.<\/p>\n<p>But big operators fear that any changes could make it easier for Ofcom to implement measures that contain mistakes or incorrect assumptions (e.g. Ofcom&#8217;s semi failed attempt to loosen Sky&#8217;s grip on premium TV film and sports content).
