{"id":6301,"date":"2014-03-17T13:10:57","date_gmt":"2014-03-17T13:10:57","guid":{"rendered":"http:\/\/www.ispreview.co.uk\/?p=6301"},"modified":"2014-03-17T13:12:13","modified_gmt":"2014-03-17T13:12:13","slug":"bt-repays-1-2m-fully-unbundled-isps-phone-providers","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2014\/03\/bt-repays-1-2m-fully-unbundled-isps-phone-providers.html","title":{"rendered":"BT Repay GBP1.2 Million to Fully Unbundled UK ISPs After Mistake"},"content":{"rendered":"<p>It\u2019s only a drop in the ocean but <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a> has agreed to repay over \u00a31.2m to fully unbundled (LLU MPF) ISPs and phone line providers, such as <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/bskyb\" rel=\"nofollow\" target=\"_blank\">Sky Broadband<\/a> and <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/tt\" rel=\"nofollow\" target=\"_blank\">TalkTalk<\/a>, after a &#8220;<em>mistake<\/em>&#8221; in its response to an earlier <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> review of the operators charge controls meant that a key piece of information was left out.<\/p>\n<p><!--more--><\/p>\n<p>The issue stems from one of <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a>&#8217;s May 2013 information requests, which formed part of the regulators charge control review for <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a>\u2019s <strong>Local Loop Unbundling<\/strong> (LLU) and <strong>Wholesale Line Rental<\/strong> (WLR) services (i.e. telephone\u00a0\/ broadband\u00a0lines).<\/p>\n<p>In short, <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\">Ofcom<\/a> requested details of <a href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" rel=\"nofollow\" target=\"_blank\">BT<\/a>&#8217;s total quantity of faults, impairments or imperfections for the period of 1st April 2008\u00a0&#8211; 1st February 2013. But BT ended up only sending data for 26th March 2011\u00a0&#8211; 15th March 2013 because, according to the telecoms operator, the &#8220;<em>data prior to 26 March 2011 was not available in line with BT\u2019s Information Retention Policy<\/em>.&#8221;<\/p>\n<p>However\u00a0it later became apparent, as part of further proceedings before the <strong>Competition Appeal Tribunal<\/strong> (CAT), that BT did in fact hold data on fault rates for the relevant pre-March 2011 period. The information was eventually provided on 15th November 2013, following another request from Ofcom. Once received\u00a0the regulator\u00a0was able to adjust their charge controls, which resulted in another reduction to the MPF rental of <strong>\u00a30.34p<\/strong>.<\/p>\n<blockquote class=\"bq1\"><p><strong>Ofcom&#8217;s Statement<\/strong><\/p>\n<p><em>BT has accepted that the information provided to Ofcom on 15 November 2013 should have been provided in response to the 13 May Information Request. BT has explained that its team responding to the 13 May Information Request made a mistake in its approach to responding to Ofcom\u2019s request and that this mistake was not identified at the appropriate time because an independent review of BT\u2019s response did not take place. BT has apologised for this error and for the resulting delay to the correction to the charge controls.<\/em><\/p><\/blockquote>\n<p>Ofcom states that BT has now agreed to repay, to each of its MPF consumers, the difference between what they have paid and the amount that they would have paid but for BT\u2019s error (total of <strong>\u00a31,200,000<\/strong> in aggregate).
