{"id":7422,"date":"2014-08-15T11:10:14","date_gmt":"2014-08-15T10:10:14","guid":{"rendered":"http:\/\/www.ispreview.co.uk\/?p=7422"},"modified":"2014-08-15T11:10:14","modified_gmt":"2014-08-15T10:10:14","slug":"warwicknet-plans-broadband-network-expansion-via-uk-code-powers","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2014\/08\/warwicknet-plans-broadband-network-expansion-via-uk-code-powers.html","title":{"rendered":"WarwickNet Plans Broadband Network Expansion via UK Code Powers"},"content":{"rendered":"<p><a class=\"shortlink shortlink-133 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\" rel=\"\" title=\"ofcom\" data-chref=\"https:\/\/www.ofcom.org.uk\">Ofcom<\/a> has today proposed to grant Code Powers to ISP <a href=\"http:\/\/www.warwicknet.com\" target=\"_blank\">WarwickNet Ltd.<\/a>, which would make it simpler for them (e.g. easier approval for street works) to roll-out their &#8220;<em>superfast<\/em>&#8221; and &#8220;<em>ultrafast<\/em>&#8221; broadband network by, among other things, making use of BTOpenreach&#8217;s cable duct and pole sharing (DPS) products.<\/p>\n<p><!--more--><\/p>\n<p>At present <a class=\"shortlink shortlink-17 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/warwicknet\" target=\"_blank\" rel=\"\" title=\"warwicknet\" data-chref=\"https:\/\/www.warwicknet.com\">WarwickNet<\/a> supplies broadband services to business parks and residents located near those parks around <strong>Warwickshire<\/strong> and other <strong>Midlands counties<\/strong> (i.e. specifically those areas that the big ISPs tend to shun), although it believes that this can be done &#8220;<em>more cost effectively and efficiently than any of its incumbent competitors<\/em>&#8221; with the right powers.<\/p>\n<p>By comparison the current situation forces <a class=\"shortlink shortlink-17 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/warwicknet\" target=\"_blank\" rel=\"\" title=\"warwicknet\" data-chref=\"https:\/\/www.warwicknet.com\">WarwickNet<\/a> to apply for individual licences under section 50 of the <strong>New Road and Street Works Act 1991<\/strong>, which is a time consuming and thus costly process. In addition, the ISP states that some <strong>private landlords<\/strong> are able to stop the provision of their service to business parks by &#8220;<em>delaying or failing to respond to [their] access requests<\/em>&#8220;.<\/p>\n<blockquote class=\"bq1\"><p><strong>Ofcoms Statement<\/strong><\/p>\n<p><em>The Applicant asserts that business parks often suffer from low broadband speeds and, without the Applicant\u2019s intervention, would not be afforded the opportunity to obtain improved services.<\/em><\/p>\n<p><em>The Applicant states that this is because business parks are considered to be low density, uneconomic projects by incumbent providers. The Applicant considers, therefore, that it is delivering a substantial benefit to the public and to UK businesses by providing high speed broadband services to previously neglected areas.<\/em><\/p>\n<p><em>For these reasons, <a class=\"shortlink shortlink-133 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/ofcom\" target=\"_blank\" rel=\"\" title=\"ofcom\" data-chref=\"https:\/\/www.ofcom.org.uk\">Ofcom<\/a> considers that granting the Applicant Code powers would benefit the public.<\/em><\/p><\/blockquote>\n<p>Apparently WarwickNet&#8217;s network is currently &#8220;<em>made up of roadside cabinets and associated duct infrastructure<\/em>&#8220;, with fibre optic lines being leased from other providers (their cabinets and underground footway chambers are used to connect to third party networks). But sometimes the ISP cannot reach a provider\u2019s network and so on those occasions it deploys underground ducting (i.e. conduits) from its cabinets in order to establish a connection point.<\/p>\n<p>In the long run WarwickNet said that they&#8217;d like to make use of <a class=\"shortlink shortlink-145\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/go\/britishtelecom\" target=\"_blank\" rel=\"nofollow\" title=\"BT\">BT<\/a>&#8217;s cable duct and pole sharing products (we assume this means <strong>Physical Infrastructure Access<\/strong> [PIA]), although these are only available to ISPs with <strong>Code Powers<\/strong> (hence the application).
