{"id":8520,"date":"2015-01-22T10:58:55","date_gmt":"2015-01-22T10:58:55","guid":{"rendered":"http:\/\/www.ispreview.co.uk\/?p=8520"},"modified":"2015-01-22T10:59:50","modified_gmt":"2015-01-22T10:59:50","slug":"blow-uk-mobile-coverage-plans-landowners-win-access-charges-fight","status":"publish","type":"post","link":"https:\/\/www.ispreview.co.uk\/index.php\/2015\/01\/blow-uk-mobile-coverage-plans-landowners-win-access-charges-fight.html","title":{"rendered":"Blow for UK Mobile Coverage Plans as Landowners Win Access Charges Fight"},"content":{"rendered":"<p>The <a class=\"shortlink shortlink-98 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/cla\" target=\"_blank\" rel=\"\" title=\"country land and business association\" data-chref=\"https:\/\/www.cla.org.uk\">Country Land and Business Association<\/a>, which represents thousands of landowners from across England and Wales, appears to have partially won its recent complaint against the Government&#8217;s proposal to regulate the price that landowners can charge telecoms operators for access to their land.<\/p>\n<p><!--more--><\/p>\n<p>The original proposal came alongside a batch of <a href=\"http:\/\/www.publications.parliament.uk\/pa\/bills\/cbill\/2014-2015\/0124\/amend\/pbc1240801a.pdf\" target=\"_blank\"><span style=\"color: #227ab4;\">amendments<\/span><\/a> to the <strong>Infrastructure Bill<\/strong>, which included a plan to replace the existing <strong>Electronic Communications Code<\/strong> (ECC). The ECC is, among other things, responsible for regulating the agreements that can be reached between landowners and communications companies regarding the location, installation and access to infrastructure.<\/p>\n<p>The Government put the amendments forward (<a href=\"http:\/\/www.ispreview.co.uk\/index.php\/2015\/01\/rural-uk-landowners-angered-new-mobile-network-coverage-deal.html\" target=\"_blank\">here<\/a>) as part of their wider agreement with the United Kingdom&#8217;s major mobile operators before Christmas (<a href=\"http:\/\/www.ispreview.co.uk\/index.php\/2014\/12\/uk-mobile-operators-agree-5bn-deal-extend-geographic-coverage-90.html\" target=\"_blank\">here<\/a>), which included a key pledge to extend the geographic coverage of their mobile networks (voice and text) from 80% today to 90% by 2017 (note: 85% for <a class=\"shortlink shortlink-115 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/3g\" target=\"_blank\" rel=\"\" title=\"3g\" data-chref=\"https:\/\/www.ispreview.co.uk\/broadband_mobile.php\">3G<\/a> and <a class=\"shortlink shortlink-116 shortlink-chref\" href=\"https:\/\/www.ispreview.co.uk\/index.php\/link\/4g\" target=\"_blank\" rel=\"\" title=\"4g\" data-chref=\"https:\/\/www.ispreview.co.uk\/broadband_mobile.php\">4G<\/a>).<\/p>\n<p>Unfortunately gaining access to private land can sometimes be a complicated business, especially when the landowners attempt to charge very high prices for access (<strong>wayleave agreements<\/strong>). As a result the Government had hoped to make this process easier and cheaper, although the CLA rejected the idea by claiming that it would &#8220;<em>diminish landowners\u2019 rights to negotiate a fair price with global communications companies for the location of telecommunication masts and underground cables<\/em>&#8220;.<\/p>\n<p>However yesterday&#8217;s debate on the new Infrastructure Bill appears to have resulted in the proposal being withdrawn.<\/p>\n<blockquote><p><a href=\"http:\/\/www.publications.parliament.uk\/pa\/bills\/cbill\/2014-2015\/0154\/amend\/infrastructureaddednames.pdf\"><strong>Infrastructure Bill &#8211; Amendment 91 (10028)<\/strong><\/a><\/p>\n<p>Secretary Patrick McLoughlin<br \/>\nChris Bryant<br \/>\nJohn McDonnell<\/p>\n<p><strong>Page 55, line 32, leave out clause 49<\/strong><\/p>\n<p><em>This amendment and amendments 106 and 107 remove clause 49 and Schedules 8 and 9 which included provision replacing the telecommunications code in Schedule 2 to the Telecommunications Act 1984 with a substantially revised version called the electronic communications code, and made related consequential amendments. The existing telecommunications code will accordingly continue in effect.<\/em><\/p><\/blockquote>\n<p>It&#8217;s unclear how this will impact the current plans, although it&#8217;s likely that the issue will need to be debated again in the not too distant future. Naturally the CLA are pleased and the organisations President, <strong>Henry Robinson<\/strong>, said: &#8220;<em>We are pleased Ministers have decided to withdraw this Code. There were deep flaws with what was proposed. It was too complex and unworkable for all sides<\/em>.&#8221;<\/p>\n<p>&#8220;<em>We are keen to collaborate with the Government to secure reform of this Code. The end objective we all want is better mobile coverage in rural areas that are currently all but cut off from the communications that are part of everyday life for most.
