aspire internet no mac code

oh there will be waves i have seen a solicitor who instead of handling it himself can proffer the case to the scottish advocates society simply because of aspire playing silly buggers,as posted earlier their costs will be astounding as they have no comeback for not supplying me with a mac code under ofcoms gen article 22,they have left themselves wide open on that one issue alone,that is the reason for putting it to a qc stable, as they wont take on a case they wont win,
 
spoke to trading standards yesterday about sending payment to aspire with the assurance that they would give me my mac code, was asked to contact the liquidators whe were very helpful saying that aspire internet no longer exists as they now trade under aspire internet solutions, but he did ask who the email bill was from and as it was headed aspire internet ltd, as is their website still advertising as aspire internet limited, so i have no idea who im paying by them just giving me a bank account number and sort ode to pay the amount into, also in the emails i recieved was the name eurisp in a url
 
I don't envy you gmm, being put through all this.

If we had a few more people reporting this same charging problem then I could probably do a news item about it.

I take it Aspire are contactable but still refusing to issue the MAC without you paying a fee first.
 
hello mark yes i was going to pay just so i can get connected with xilo, but the new bank details, just an account number and sort code worried me, just where or who am i making the payment to? and what will i recieve in the way of a reciept?, contacted the liquidators and they said that they can not trade as aspire internet ltd as that company is in liquidation, and that they are now calling themselves aspire internet solutions, yet the email i got from them was headed aspier internet ltd and even a reference to eurisp, i informed the liquidator that the website is still showing and as aspire internet ltd, and that when i asked them on the phone as posted before, if it was the same company name , staff, director etc, was told yes, im waiting a call from the liquidator as how to make a safe payment in reciept of my mac code, thought it was quite comical as im thinking of making a payment to settle this so i can get my mac code that i have had no connection from friday 11th

Indeed, you're going about this in the right way.

Just remember to keep as many records as possible and you might be able to claim the money back through an ADR scheme if Aspire is still trading when the conclusion drops down. Any ADR outcome would be in your favour as ISPs cannot withold a MAC like this, unless you already had one issued by the same ISP before but didn't use it.
 
If you can get a fully unbundled service (phone line and broadband) at your exchange, such as offered by Sky, and I believe Bethere, or talktalk :eek: then you could transfer your phone line and you wouldn't require a MAC.

Other than that, as Ofcom have proved useless again, I'd suggest writing to your MP and asking for their help.

Indeed, you're going about this in the right way.

Any ADR outcome would be in your favour as ISPs cannot withold a MAC like this, unless you already had one issued by the same ISP before but didn't use it.

Presumably they also can not legally charge for any service during the period they've withheld the MAC code, preventing the OP from leaving.

when i phoned them last week for the total to pay so i can get my mac, they did say that i continued to use the service after i cancelled the direct debit, i did explain i had no choice BUT to use it as you wont give me my mac , will contact the liquidators tomorrow as they said they should contact me by tue, i will keep in mind the adr, cisas, and my local mp, but my last action will be the civil action against them on a point of principle as i have no intention of financial gain out of this except what i am duly owed, maybe they think im bluffing as a member of the "ordinary" public who hasnt the means to forward an action against them

lol, thanks butler, its no cost to me at all,as im entitled to legal aid,hence the solicitor putting the case to a qc at aspires expense, aspire internet ltd is in liquidation, but they are carrying on the company now as aspire internet solutions, err who's amanda burton? lol, off to google
 
spoke to the liquidators, refresh, and they still havent got word back from mr longton, was told as my contract was with aspire ltd that payment would need to go to them(refresh) and that they will recieve my mac code and pass it on to me hopefully,which makes sense to me, apart from having to actually pay for a mac code lol, but that will be sorted at a later date when this fiasco is finished

aspire internet ltd can not trade anymore according to the liquidators and it would be illegal for them to take payment from me directly as it has to go through refresh recovery(liquidators)yet when i phoned aspire they gave the usual guff about thier terms and conditions, which are headed under aspire internet ltd so in that case they dont apply as the company doesnt exist, will go to an adr cisas they are listed under i think, when i have gotten the mac and can then get things rolling, loljust waiting a reply now from refresh recovery to what the next step is

got word back from the liquidators who were in contact with tim longton his reply was that im actually a customer of aspire internet solutions ltd, if thats the case why was my direct debit which was cancelled in sept 2010 being paid to aspire ltd ? and at what date did aspire ltd change their trading nane to aspire internet solutions? therefore their terms and conditions that they keep quoting and are charging me extra for are useless as they are stated to be for aspire internet ltd which no longer exists, and why was i not contacted as a "customer" of the name change to the company as they did before changing from eurisp to aspire ltd ? all questions that will be probably asken when the time comes by better legal trained minds than me lol

It might be worth contacting Ofcom to clarify if aspire internet solutions is a member of an ADR scheme - presumably they can't claim the liquidated company's membership is applicable to them. If I recall correctly, if they fail to join an ADR, then Ofcom can fine them up to 10% of turnover.

heya mel i cant see how the can be as even their terms and conditions dont even relate to aspire internet solutions ltd, so therefore any terms and conditions they are applying to me are false

Report them to Ofcom then, ofcom should fine them if they fail to join an ADR, and if they do join one to avoid a fine, you'll be able to make a formal complaint, requesting your MAC and a refund of your costs.
 
checking with cisas and ofcom they are still listed as aspire internet limited, lol, they have already ignored ofcoms request for my mac code three times, and ofcom said they can do no more to help me
 
well payment sent recorded delivery and recieved on the 25th by them have emailed 7/3/11, asking why they have not contacted or mailed me the code,as usual no reply from them, they really are intent on digging themselves into an even deeper hole than they already are in :shrug:
