Biscit issued a warrant

I WIN... I WIN....

As some of you may know, I paid Biscit £30 for a MAC code way back in October 2006 which was never issued to me. Despite repeated requests asking for the money back (when I was wall gardened by EzeeDSL), Biscit never replied - they totally ignored me.

I decided to go to the small claims court to retrieve my money.

I have now been through the complete process, again, Biscit decided to ignore the courts letters to either accept or deny my claim.

Yesterday, I applied for and was granted a warrant. This was approved this morning and means that the claim will be sent to bailiffs at Biscit's area local court. The bailiffs give Biscit a further 7 days to pay up or would then seize assets to sell on to the value of my claim which has now reached triple figures (almost).

Surprise surprise... Today, I got a hand written cheque & letter from Biscit for the amount due prior to the payment I made for the warrant being issued.

So.... I got my money!

However, I have contacted the court (as instructed) to notify them that payment (less the bailiff fees) has been paid.

I am not sure if I will now loose this money I paid for the warrant or if they still insist Biscit pay the remainder.

But the good news is.... I win... I win..... sort of!

Thanks to everyone for their support since October. The moral of my story is...Don't ever give up. Not all is lost - The good guys (and gals) always wins in the end! :nod:
 
A good moral victory with some satisfaction. Really you deserve far more in compensation for all the worry and hassle they caused.

I left V21/Biscit at the end of December, they took a payment in January and I've written my credit card company (they've acknowledged) to block any more payments (well at least retrieve them) but it remains to be seen if the nightmare is all over yet. I await my next credit card statement in Februrary....

Good one. Its shame its such a process to do that though, otherwise more people would. And then ISP's wouldnt be able to do such things.

It just goes to show that biscit is utter dirt, when they only pay up if threatened. Hopelly, biscit gets dragged through the mud and goes out of business. Though I dare say its the front line lot who will suffer, and as usual the MD will walk away with money, only to start it up again in another name.

Just shows how toothless OFCOM is really.

...and I should get that cheque into the bank ASAP as it takes 3 working days to clear....in effect you haven't been paid until then....oooo I'm getting a right paranoid old git in me old age!;)

Bluey, theirs no harm with being paranoid with anything to do with biscit, you've only got to look back at the last few months, the best roller-coaster ride doesnt compare to these people.
 
Just a thought , could you have returned the check and stated it was now in the hands of the baliffs that way you would get all the expenses back as well . Nor really sure though how these things are dealt with . But I would try to get the maximum from them . Never the less good for you for not sitting back and letting them walk all over you .

I am one happy Caretaker :D :D :D :D

It can take a few months... but I can wait!

I am pleased that you have won with no loss .Too often ISP`s think they can get away with screwing the punter thinking you will not want to be bothered with going through the Rigmarole of using the courts.

Lets hope that you have shown the way and that a few more will go down the same route to get their money back.

I think that Bailiffs will only accept cash or credit card payments, so if you let it continue you may get the lot.

I don't think County Court bailiffs can take payment by credit card as the normal court service (not moneyclaim.gov.uk) don't yet accept cards.

Whilst certificated bailiffs can usually take card payments that's because their company processes the payment and hands the debt over to the original claimant.

I remember a case a few years back when the defendant bounced a cheque for £4195.00 on a bailiff :eek:

He went back and collected the payment in cash a few days later :D

If a bailiff accepts a cheque he'll clear the cheque before sending a payment order (Paymaster General equivalent of a cheque) to the claimant.

Thecaretaker, It's very unlikely to take a few months. Once the warrant is issued the bailiff will give them 7 days to pay. If they fail the bailiff will call to see them within 15 days of the warrant being issued to either a) collect payment or b) start making a list of goods for auction.

Don't count your chickens Caretaker, the way Biscit have behaved beggars belief that they are still trading.
I suspect they are working on the premiss that Netservices will loose their battle and a fat cheque for hundreds of thousands will find it's way into the directors back pockets while the company falls through the floor. That is how asset strippers work.

Yes, congrats me 'ol fella!

I think i was damn lucky to migrate out on 6th October cos i just (and only just!) missed the Biscit fiasco. Mind you, i've returned to this forum today because i've had an email billing invoice from V21 for January's internet! Having read about their dodgy antics, i'm worried they'll take an unauthorised payment from my Visa Debit card and then they'll go bankrupt so i'll never see it back. Only way i can block it is to report my card stolen!

Poker Player : If you have a cancel letter from V21, send a photcopy to your credit card company and explain the situation and ask them to stop them taking any more money. Also refer to the reference that V21 appear on your credit card statement. That's what I did and got a letter acknowledging back from my credit card company saying if they take any more then they will retrieve it.
 
As an unauthorised transaction this would be fraud and you would be covered regardless of what type of card you used and even if the company goes bust.

In addition to that as your card is a VISA, you could obtain a chargeback for an authorised payment if a company goes bankrupt without supplying the goods or services for which you had paid.
