BT Refusing to Pay Compensation

I had a complaint with BT over the very slow and sometimes non-existant Broadband connection and submitted this complaint on the 11th December 2014. BT did little or nothing about my complaint until I submitted a second complaint through the ISPA on the 27th December 2014.

BT's Newcastle Technical Complaints spoke to me on the 29th about an engineer that had been promised for that date and never arrived. They arranged for another engineer to come and he duly arrived checked the download speed and went back to the exchange to report his findings.

The technical representative called me to say he would ring me back on the 2nd January, 2015. It became clear to me that BT had capped my line and degraded my service even further so when I spoke to the technical guy and asked him for a MAC code, he said that I wouldn't get any compensation because I was leaving BT.

Can I submit a further complaint about compensation through the ISPA against BT as I feel BT is cheating me.
 
Tricky because I assume this was for a consumer broadband service and not a business one? If so then there would be no Service Level Agreement (SLA) attached, so in a way the best BT will do is let you exit without charge (this may be a moot point if you're already out of contract).

It's of course also probable that the same performance issue may exist when you switch ISP, especially if the provider uses the same platform.
 
Try taking BT to the small claims court, just too see if that will grab their attention.
You know how big companies hate bad press.

Thanks for your posts. I believe because I purchased Unlimited Broadband and the service was limited by the fact it wasn't available in the evening and some days after 3pm makes BT in breach of their contract to supply me unlimited broadband. I was suffering dowload speeds of .18 and less and fortunately, I managed to get that recorded on the BT wholesale site.

I am intouch in Trading Standards and there there may be an infringment of Consumer Protection from Unfair Trading Regulations 2008. I will update my post as and when.

Also, yes, I am considering the Small Claims Court.

Before BT hacked; did their 'Balancing' of the Exchanges; my download speeds were between 6 and 7 and the only way it can drop is through congestion i.e. BT selling more Broadband services than their Network could cope with.

Legal route is probably the one i would choose, i have myself threatened BT with legal action before, and they give in..
 
Thanks for all the help Guys - have spoken to Citizens Advice Scotland and there is a wonderful piece in Scottish Common Law that says that the service provider should show reasonable care and skill and if they don't then they are in breach of contract and I can claim damages off them. If they don't then Trading Standards could wisper in the ear :) I have sent BT a letter giving them 5 days to agree compensation with me.
