Can they do that ? (Plus.net)

Ok, i represent a person who i helped to sign up for plus net on march 2005 (if i remember correctly).

Now, more than a year on, they never received a "starter pack", but monies been withdrawn from a credit card.

Now, to clarify, how all went while signing up.

Plusnet had a phoneline checker at the site then, obvious and visible, so before proceeding we checked the line. At the time i didnt know much about how aDSL works in UK, but i was convinced that an ISP of plusnets reputation (then spotless) would warn me of possibilities of getting the bad signal and all that. As far as i know, they did it only after the debited the card and suspended any further transactions.

So, now my client asks me to get a full refund. At this point i have to dig out login/password for plus net portal to complain. And as i feel as my reputation has been violated by plusnets actions, i either get full refund for undelivered service, or i will have to refund from my pocket money.

Can they do that ? I mean, people are out of pocket for more than 100 pounds (we "bought" a router with the 512k deal). Is it legal ?

Now, i have notified owners to check the line with the help of BT technicians if they can get BB at all (and aparently they can), but i really doubt i want to get them into the mess that plusnet is at the moment.

So, if anyone has a good idea as to what course of action i should take, i would be grateful.

ok... to me this looks like someone has paid plusnet for 18 (ish) months worth of broadband, but hasn't received any service to date...

... if this is the case, then why hasn't this person tried chasing them up before now!

If you bought a router for £100 and it hasn't arrived -then they should have told plusnet, that it hasn't been received... and/or the credit card company that plusnet haven't delivered the router
 
There were no payments for "service". The 100+ quid was for router (instead of cr@p modem) and so called "activation".

If they would try a stunt of charging for service - well, i can tell you that they would be in a looooooot of trouble by now...

Let me put it this way. 100+ quid for this person is, well, nothing really. But the fact that it was paid for items/services never received that gets to him. And in turn it screws up my rep as an IT tech.

I must admit, when i started my IT "business" here (i'm a foreigner to UK), i didnt know much about UK broadband structure, so, there is a part of my blame. I should have asked BT to check the line thoroughly before ordering, but what a hey... stuff happens...

well... why didn't they try contacting them some time ago about this modem.... why not just ask for a simple refund?

I think under sales of goods act, you are legally entitled to a refund, if your purchase is not of a satisfactory quality or you don't recieve it at all I believe so I think you do have a legal right to a refund.
 
Although I think the various legislation would apply, the downside to this is the length of time between non-receipt and notification to the company. I is normally accepted that the customer will notify the supplier of non-receipt within a limited time frame after the deadline for the goods being recieved. Difficult to be exact as a lot of this is tied with the Terms & Conditions of Sale at time of purchase. As we it looks like we are talking over 12 months and the supplier has not been notified, I don't think there would be case against the supplier. That is of course if the supplier can prove that it sent the goods in the first place.
