This Internet access package is introduced to you by breathe but is provided
to you directly by Affinity Internet Limited (Victoria House, 64 Paul
Street, London EC2A 4NG). The following terms and conditions form a binding
agreement between Affinity Internet Limited and you:


1. Your monthly subscription for this Internet access package is £8.99, to
be paid in advance.

2. This will allow you off-peak access to the Internet (between 4pm and 8am
Mon-Fri). Outside of these times you will be charged for your Internet
access on a metered basis as follows:

i. Peak (Mon-Fri 8am-4pm) 2p per minute
ii. A minimum call charge of 5p will apply to all metered calls.

3. All prices in this Agreement are inclusive of VAT. Payment must be made
via direct debit or a valid UK credit card (Visa or MasterCard) or debit
card (Switch or Delta only). We reserve the right to charge interest at the
rate of 2% per month above base rate of the Bank of England on any overdue


4. You can cancel this Internet access by telephoning the Help Desk. You
must give us 14 days notice. No part of your monthly subscription will be
refunded. You will also have to pay for any metered Internet access you
used up to the date of termination of your access.

5. If your account is overdue for more than 14 days or you are in breach of
any of the terms of this Agreement we reserve the right to terminate your
Internet access.


6. You need to ensure that you are using the correct dial up number to
access the Internet. It will begin with 0808. We will not be responsible
for charges you incur if you are using the wrong number.

7. You will need a BT Line which is capable of being identified and must not
be withheld or ex-directory.

8. You will only be able to access the Internet from the phone number you
provided to us at registration. This access package is not available from a
mobile phone.


9. This access package is not designed as an "always on" service. Like most
Internet services it uses technology that is shared and therefore excessive
use by users can severely affect the service offered to others. In order to
ensure a fair service for all users a "Fair Usage Policy" is adopted. This
operates in two ways:

i. Your Internet connection will be automatically disconnected if no
activity is monitored on your connection for 10 minutes and after 2 hours of
continuous connection regardless of activity. If you use software or other
methods to counteract cut-off measures we reserve the right to terminate
your subscription.

ii. This product is designed to allow access to the Internet for up to 20
hours per week on average. You may exceed 20 hours per week on occasions,
but if you do so frequently we may require you to desist or register for a
more suitable product


10. A Technical Help Desk is available (7 days a week, 24 hours a day) at a
rate of 50p per minute.

12. If any of your personal details changes please let us know immediately.

13. We reserve the right to terminate or vary these terms by giving one
month's notice.

14. If we need to contact you we may do so by emailing you at the email
address you first registered with breathe or by posting at message at
<a href="http://www.breathe.com." target="_blank">www.breathe.com.</a> Please check your email regularly.


15. This access package is offered to domestic customers only.

16. Once you begin to use this Internet access package the Consumer
Protection (Distance Selling) Regulations 2000 will not apply.

17. You will promptly install any software update, patch or download that we
advise you to use. We will not be responsible for any charges you incur if
you do not perform such installing including (without limitation) call
charges you incur as a result of using the wrong dial-up number.

18. The access package described above is provided on the terms of the
Subscriber Agreement you entered into as a part of the registration process.
To the extent that these terms and the Subscriber Agreement conflict, these
terms will prevail.

Please read these terms and conditions carefully to ensure that you
understand them. Once you complete your registration process, you will have
entered into a legally binding contract for the provision of the access
service with Affinity Internet Limited.

If you have a printer attached to your computer it is suggested that you
print these terms and conditions for your future reference.

thort id join up so i could have a rant!! :D
i am with breathe at the moment and their service is really beginning to suck. i am now paying £9.99 and ok i do use the service excessively some weeks (left on overnight downloading) but my main problem is dialling in throught the evening. it takes me upto 30mins some nights. i have emailed support loads of times but heard nothing, and i even received a mailer saying they would be forwarding alt. dial ups out the following week. that was back in july.

i am waiting for broadband to be turned in my area then bye bye breathe.
