Data Protection

For reasons that are too boring to repeat, Vispa have taken exception to my posting on their forum and had blocked my posts.

Having been blocked from contributing to the forum for some time I was just reviewing the site when I came across a thread in which my user name is published (without my consent). I had been posting under the soubriquet of 'carstairs'.

I believe this is a breach of the Data Protection legislation and have said so on the Vispa site but they will probably censor my response, the usual response.

Is there an expert out there? Is this a breach of Data Protection?

It would not be a breach of the data protection act. There is considerable misunderstanding as to what the purpose of the data protection act does and what is covered. The use of a persons name would breach the act in shape or form.
 
I think it depends on exactly what information was used.

You have used the username 'carstairs' on the Vispa forums before (you chose that name and used it publicly), therefore it is in the public domain anyway by your choice, so there is no data to protect - by using the name carstairs on the forum, you have made it public.

If, however, they have published personal information which is not protected and you have not authorised to be made public - ie full name, address, phone, email, inside leg measurements, download history etc etc, then that would be a breach in my view.

Another point - if they have used your name in order to discuss your behaviour or criticize you, it may be worth requesting the opportunity to defend yourself, or even just requesting they remove any references to your username.

By signing in to the vispa forum as 'carstairs' I appreciate this 'nickname' is in the public domain.

However, in a criticism of me, vispa referred to me as 'carstairs' and by my vispa user-name, without my consent. That user name contains my real name and allows anyone to deduce my email address.
 
Vispa have 'pulled' the offending reference but, not surprisingly, with no apology.

They have a very arrogant and dismissive attitude to customer's interests and even if it transpires publishing my details is not a breach of Data Protection legislation it is certainly very discourteous.
