Dell replace faulty Monitor with REFURBISHED & FAULTY

I am disgusted, not in the fact it took almost a month to get a replacement DELL E773P, but the one I got back was refurbished AND faulty. Looks like I'm going to wait ages for a replacement.

The monitor that was replaced suffered intermittant high pitched whistle. The replacement monitor is suffering from a tube related problem. The screen flickers and whites become cream - it does sort itself out after a couple of hours and the screen settles, but that ain't the point. I have been swapped a faulty monitor for another faulty monitor. And surely that is against the trade description act?

So I have contacted DELL via email so I'll wait at least 48hrs (yep!) and then be told to check the monitor cable, the connection and run the monitor self test. Then in a couple of weeks, they will arrange for a courier to come to me (why didn't I by from a shop - I'd got faulty replaced for new!). In the mean time I'll probably buy a flat screen.

It depends how long you have had the monitor, after an initial period the supplier can offer to repair or replace with a refurbished one, it would be different if you thought the monitor had a fault when you first purchased it then you could claim the "not fit for the purpose......" part of the law.
It is another subject but the consumer act needs to be changed a bit more in favour of the customer.

Getting a refurbished replacement is nothing out of the ordinary if the monitor is older than 28 days. It cannot be considered an out-of-box failure if it's a few months old, however if it's less than a year old (or older depending on the warantee), this could be classed as a manufacturing fault.

While talking monitors, I have a nice 19" flatscreen, with a few pixels missing on the display. How many pixels need to go before I can exchange this one. The monitor is not even a month old yet, but I understand I can only swap it if enough pixels are out.

Well, the PC was invoiced on 30 June, Dell finally made their first contact on 28 August, after they were contacted on 21 August! They were aware the fault was intermittant and had just got worse.
To quote the Dell warranty
".. will be free from defects for 12mths from delivery..."
"Should a product be defective within this period. Dell will repair or replace Product within a reasonable time...."
"Dell manufactures using components that are new or equivalent new in accordance..."
"Spare parts may be new or reconditioned...."

Well I don't think a month is reasonable!
This would mean I would expect to be shipped new, or a cancelled order monitor, not a refurb.
The monitor is not a "spare part"

The annoying thing is the replacement is worse than the original. I left the PC on during the day and when I come in a half hr ago, the screen had a yellow tint across it.

Well 56hrs later still nothing from Dell and Warwickshire Trading Standards say write to the head man at Dell in Bracknell - anyone know his name, or the head of customer complaints? :(

Miracle, an Internatiomal Phone Call.

A gentleman called Raj, caled to say he would arrange for a replacement "Brand New" monitor to be shipped! He did go on to say that normally refurbished monitors are normally not 2nd hand (in this case mine was), although he understood when I said mine had the monitor base already attached. Looking at the base, I would say the scratches would indicate the monitor was definately second hand. :hrmph:

I'll let the readers know whether I get what I've been promised.

Getting a "brand new monitor", well thats what dell tec support say, should be with me in a fortnight!

{When that dies, remember to pop down to Stak Trading (www.online.stak.com) and get a replacement from them, no postage just a 10 min walk}
