Fast 4 Contracts

Can anybody help?

I joined fast 4 on the 27th July 2007 and have had no end of problems with their site being down. I looked at cancelling and it says

"You are currently in contract. This is due to expire on 27 August 2007. After that date you will be able to gain access to this option."

Does this mean that I can cancel after this date without penalties.
 
As a fast4 customer who did cancel......I think you should look at everything in the fast4 part of the forum especialy some posts I've made recently. Not as easy as made out to be and you will be charged.

I think this would be classed as a 12 month contract as it is worded as a contract. Yet they advertise as a 1 month contract.

Actually they advertise "no long contracts" and say on the site "no contracts","no catch", etc,etc

Technically the MAC is probably being supplied free - but she needs to be aware of these charges. I believe that the reason this does not count as a 12-month contract is because leavers are not expected to pay any additional rental.

Don't know if I'm correct - but that's how it reads to me

If you leave fast4 within 12 months i believe its a £20 fee for migrations in and £80 if you are a new connection.
 
I was with Fast4 for just one month asked for my Mac code received within five days charged £34 don't know where this £80 is coming from but that is all i was charged unless they surprise me next month,now set up wiyh my new ISP:laugh:

You must have migrated in, those using MAC keys are charged £20 plus
any remaining days for 28days notice. Those that were new activations have an £85 bill for an approx £50 BT activation charge.
 
I have am now using my new connection to access this site. So far my speeds have been at least ten times faster than what I had with fast4, with no disconnections!

Fast4 are trying to make me pay £85 for cancelling 2 months before the 12th month. I have taken my complaint to CISAS. My main argument being that I exited because of poor or non service not because I changed my mind. I will let you know how I get on.

Due to the length of time these problems have lasted I feel you should be allowed to leave with no charge MPO

Please keep the forums updated on how it goes and watch out Ithink one other member ended up paying as Fast4 sent in the bailiffs which I felt was totally wrong since thye failed to supply him with the service he was paying for.
 
Yeah thanks for the heads up on the bailiffs. I checked with OFCOM, they cannot proceed with any claim as long as I am dispute and I have raised it through the formal complaints procedure.

If CISAS come back to me and say I have to pay for it then I will give Fast4 the money to avoid the bailiffs. Then apply to a small claims court under the supply of goods act and false advertising. I am not going to let Fast4 get away with it.

I will post all my results on the site as soon as I hear back from CISAS.

Ive been wondering about that. Can anyone with a legal mind define that then?

Some say its not a contract because they dont charge you for the remaining months subscription.

But others say it is a contract because if you leave within a given timeframe (12 months in this case), you have to pay a fee.

Id have thought that as you are agreeing to terms and conditions set out by an other party, this counts as a contract and paying them these fees if you leave within 12 months is part of that contract.

If this isnt a part of the contract, what exactly makes it legally binding?

Well the bit I would refer to is this page:

Which specifically says "no 12 month contracts"... which in itself is a fib because you get penalized if you leave the service in a 12 month period. Or maybe there isnt a 12 month contract like they keep telling me. Maybe its a charge for a MAC code under a different name.

My main argument is that they couldn’t provide a "broadband" service so therefore I shouldnt be trapped into their terms. I have only been with new provider for the past 4 days and my speed, line and service has been faultless - So much for my BT line and all the other crap farse4 came up with.

So annoyed with them and their back garden shed project.
