Get out of contract - Phorm

I was just wondering, if anyone was in a contract where they had to pay to leave for any remaining months, would they be able to use Phorm as a way of getting out?

My guess is no, as BT etc will simply say you can opt out.

Any opinions?
 
It was mentioned in the new FAQ that they were amending the T&Cs, so it should be possible to walk (well run).

A new paragraph (paragraph 18) will be added, explaining that Webwise is available as part of BT's Total Broadband service. That paragraph will also capture customer consent for us to take the necessary technical steps to switch the service on or off, as appropriate (and will make it clear to subscribers that they are responsible for making sure that other users of the service in the household are aware of Webwise and know how to switch it on and off).


So once they add that clause (which they may have done so by now), BT users should be able to get out of their contract for free, for a limited period of time before they will be deemed to have accepted the detrimental change.
 
Na you can’t I have already spoken to Virgin media, they not letting me out of the contract even I was moving home, I been with them for years, Apparently the contract renews every year (automatically ). I feel like I had been ripped off.

I have just canceled VM after many years infact come july 20th it would be 8 years since I went live on cable july 20th 2000. 12.30 :D still have the old T&C all 40+ pages. It was never used to update and they wil not be getting any money out of me I did my contract 12months and it was then monthly renewal. Contact OFCOM and trading standards might aswell set them onto VM like we do all ADSL ones that fail customers. :D
 
Agreed, don't just take your ISPs word for it, if you want to get out then make complaints and contact the appropriate bodies.

Man that sucks. Once the initial contract has expired, every customer should be allowed to leave. It's just plain dirty tricks to automatically renew it every year without the customer consent. If this is how VM treat their customers, they don't deserve any.

With all the ISPs that I know of, once your initial month contract is completed, you are on a month by month basis, so you can then give a month's notice at any time.

Beware of companies that do automatic contract renewals. These are ones that state in the T&Cs when you first sign up that after the initial contract has expired, they will renew the contract for another 12 months each year unless you notify them before each year is up that you no longer wish to be with them.

I can't think of any company doing that now, mind, because it was deemed to be "an unfair contractual clause" by the authorities.

I was under the same impression but apparently not The guy I spoke to was an idiot I was trying to cancel that guy is talking about how I use internet a lot and no other isps will have me etc. I was like wtf that not ur worries dude just let me out then only he come up with this bull saying that I can’t cancel contract as it’s auto renewal contract etc I have to pay up the rest etc

As Mark and Kitty I'll be sending a letter to OFCOM and trading standards see what happens. if all fails I'll be using excessive so will get banned from them and find good ISP on my wife's name :D
 
Had a good laugh VM wrote to my husband since his name was on the account that is canceled. Asking us to reconsider that we don't need to change supplier to change our digital package.. Added in a leaflet telling all the packages they have on offer with in large letters on the front sleep on it inside a black eyemask to block out daylight with the words virgin media on it :D

You might even want to try with the ISP again - sounds like you got a right con artist this time - I would assume (hope?) that most aren't like that.

Just call up again and don't mention that you have been told about the auto-renewal.

I'd try telling them you'll take action against them in the small claims court if they try and charge you for this. That might wake them up - at least enough to wonder if fighting you's worth the aggro.

That sounds like a very questionable "contract". I don't know if there's any case law that says it's valid, but it's certainly worth arguing that you can't be bound by a contract that you weren't aware you'd entered into. It's not up to you to prove you haven't got a contract, it's up to them to prove you have.

Going to the small claims court is much less hassle and expense for you than it is for them - and, i believe, they've lost a similar case in the fairly recent past, so they should be wary.

Virgin are a member of the ISPA, so a complaint to them could be worthwhile. I'd also try telling them that I want a deadlock letter so I can complain to their arbitrator CISAS before threatening legal action. CISAS should be MUCH more expensive for them than the small claims court costs.

I joined Cable for BB in july 2000 I leave it this year due to this phorm stupidity they plan.. I was not told that the contracts were renwing every year infact when I signed up was told it was 12months to start then renewed monthly making it you have to give them 30days notice to leave.

Ask them to point you to where in the T&C it says the contract renews every year to a new 12 month one?

Also ask them why at the time this was changed you were not notified of the change?

Fight them man they are desperate to stop the flood gates of leaving customers.

Ending this agreement

This agreement will continue until the end of the minimum period for each service you take. After the end of all relevant minimum periods, any party may end this agreement by giving the other 30 days' notice. You must pay any relevant usage charges and line rental up to the end of that 30-day notice period. You may also cancel a service after the end of its minimum period by giving us 30 days' notice.

So the initial minimum period is the first 12 months there after it is 30 day notice to leave.
 
I have just spoken to a customer services person at Virgin Media, and asked if the contract with them is renewed each year. The answer is "No". When I said someone had been told by a VM person that it was renewed each year, I was told that the VM person in question could lose his/her job if the bosses heard about it and found out who said it.
