line rental from one company and broadband from another

I have just ordered a new line with an annual contract for line rental and calls only from xln. I don't want to use them for the broadband for various reasons. Can they legally put a tag on the line so that I am forced to use them also for broadband? I have read a few threads on the subject of tags and their removal, but they always relate to people wanting to switch provider, whereas I want to have one provider for calls and another for broadband. Any advice would be welcome

This really depends upon what platform is being used for their phone lines, if it's WLR (BT Wholesale Line Rental) based then you're fine, if its SMPF (Shared LLU unbundled) then you still have some flexibility because the line remains largely controlled by BT but if its MPF (Fully LLU) then your operator has taken full control of the line and that usually means needing to take both services from the same ISP. XLN's website has the answer:

2. How we provide the Services to you

XLN provides services via WLR and, for telephones lines with XLN broadband, Next Generation Networks (NGN). WLR means that XLN will bill you for line rental of your BT line and BT OpenreachTM will continue to maintain your line and fix any faults that may occur. Developments in network technology (known as Local Loop Unbundling or “LLU”) may enable us to provide fixed line with broadband service to you through Next Generation Networks. If you have previously agreed to take our WLR service we may transfer you to our LLU network, but we will still offer the same services to you as those which you received from us before the transfer. If a Next Generation Network is available to you at the time of your transfer to XLN, we may transfer you directly to this network. In all circumstances your phone line from the exchange to your premises will continue to be maintained and repaired by BT OpenreachTM.

You acknowledge that in order to avoid delays occurring in the ordering process, XLN will need to be notified by BTTM of any products or services presently in use on your line that are incompatible with the WLR or NGN service. BTTM or other network providers are under a strict duty not to disclose information about a customer’s telephone services to a third party unless the customer has consented to such disclosure. In entering into this agreement you give consent to BTTM or other network providers to disclose such information to XLN. You also give XLN authority to act as your agent to arrange connection onto XLN services. If XLN is unable to take over the billing of your line rental, for whatever reason, you hereby authorise us to carry your phone calls only through CPS (see below).
I'd contact your ISP and ask to make sure that your line remains on WLR so that your broadband can stay elsewhere.

Thank you so much Mark. The local exchange if fully unbundled so I guess that the line will be controlled by XLN. This is a new line into an office I am shortly moving into and where no line previously existed. So far I have asked XLN to provide me with a line and pay for any calls and was hoping to use another ISP for a broadband service. However, having read the extract from their T&Cs in your post, it appears that the telephone calls are being routed via a broadband line, whether or not I also have their broadband service. If I then ask another provider for broadband they will undoubtedly tell me that the line is too slow. I think I will haveto cancel the order for the line with XLN and get a line from BT. I don't suppose I can ask XLN to route my calls via cps via a normal bt line? And if I get a BT line is there any guarantee that it will not also be a broadband line?

No harm in asking them for it. What do you mean by BT line? If the line is just BT WLR based then you can pick any ISP you want, on the other hand if you mean BT as in a "service" from BT Retail itself.. well.. that depends on the package you pick :) .
 
Especially if it's a business connection - personally, I wouldn't deam of having the line rental and the broadband from different companies. It provides a hole into which the customer can fall as there's no direct line of accountability for service problems, the ISP can fob you off to the line rental company and say it's a line fault, the line rental company can throw it back and say it's a broadband fault. Unless the customer is a telephone or broadband engineer (which you might well be!) they're none the wiser and left in an unenviable position.
