what is it with problems

as some may remember last year l had quite a few issues, like flooding, unfair dismissal, and getting kicked out of our home...

well through some twisted reality its happening again, last month the on site farm shop was burgled and we were blamed, the police checked our primeces and found nothing, CCTV evidence is crap whats more stupid is there are camras all over the place here and we know that so its stupid for us to be suspects knowing they went in through an area with cameras..

anywho, today we recieved a couple of envalopes listing reasons for being sacked, first and foremost we have not been convicted of the robbery in fact there is no proof we had anything to do it (after all we are innocent) however this legally worded letter has told us they are going to charge us for half their losses, all the other reasons are stupid and randomly thought up.. in any case they expect us to get out in 14 days, they wait til a weekend to tell us where to go.. pretty much fuming at the moment as l kinda saw this coming... suffice to say we are not signing the form they gave us.

anyone know of any legal professionals around hereford that are contactable at weekends that could advise or other useful ppl to call out of CAB hours?

First of all, they cannot charge you for half of their losses. That would be completely illegal. You didn't break in and take anything, therefore you are not liable for any of their losses, plain and simple. You have the law on your side.

Secondly, they can't kick you out, even if they sack you. That would also be illegal. They need a court order to get you out, so unless you have somewhere to move into, do not agree to move out, and stay put! You have the law on your side on this as well.

What I have said here is not just my opinion, it is the law! It is very important you seek legal advice, so take the advice given by chrislane above.

its a US site so lm sure they wouldnt be able to help with regards to my issue.

as things stand so far we will NOT be approaching the CAB, my sisters boyfriend warned against it and told us to talk to Community Legal Services, he told us if we went to the CAB first that the legal services wouldnt touch our case.

in any case my parents gave me permission to actually have a good read of these "legal type written documents" and after allot of thought over the day l have come to conclusions, the first being that how can they force us to pay any damages! without conviction there isnt any proof, we visited the police station yesterday and we were told the investigation will still open.

also they also gave another reason for the dismissal which was a twisted form of truth, as some may know l live around and my parents work in the dairy industry, which means its a job of high responsibility as the end product eventually goes into the food chain for various dairy based products, well the second reason is regarding worming, the boss kept on at my parents to de-worm the cows (not that they had any lol, its the same kind of thing as protecting pets from flees if you get the idea) however the product they needed to do such a thing was not there, eventually after parents informing them of this they brought over a product which was used on about 10 cattle which thankfully were not going into the food chain (some milk has to be dumped depending on if said cattle are being treated with various drugs or recently calved) because the stuff given was found to no be used on lactating cows, since none went into the tank there is no reason for dumping the milk yet they state they paid dumping fees (tho this isnt what they want us to pay damages for)

in essence, they want us to pay (as l gather) around £450 each (from both parents) to recover losses made from when they were burgled, and the 20 page legal document basically states that "if" signed we give up the right to claim unfair dismissal and everything else, however with regards to this legal document l did some searching yesterday because l was and still am somewhat apprehensive about the documents validity and found out the companies called "Lanyon Bowdler" l originally assumed it to be a name of the solicitor but l was wrong, and the reason l am suspect about the document is there is a page that seems to be from said solicitor, one of those "l hereby declare l hold legal certification, bla bla bla..." however parts of that have things like "[letter head here], [print name here], and [signature here]" which feels like this document is just to scare us and they are hoping we just sign and get away from it.

in any case we are low as we can get and yes our bark is bad but this time our bite will be much worse, because with all this happening it will affect prospective employment because tho we have not been convicted (we are innocent) we cant exactly like to any new employer about our issues, they would obviously find out about them.
 
That "legal document" is simply scare tactics to try and get you to admit to, and admit liability for something you haven't done. DO NOT SIGN IT under any circumstances. If you do, they will get the police to charge you as you will have admitted to the break in, and you won't have a leg to stand on. Tell them to p*** off. Also tell them that any further harassment will result in you taking legal action against them.

Mender, thanks for the amazing perspective you have offered knowing how some things have been twisted on the letter they pretty much want to force us to sign lm sure they would stoop to that level which means you have brought up an extremely valid point and l definitely appreciate your perspective.

as for the union, yes there are definitely some good things you get if your a member but my dad originally was in the union many years ago but they caused more problems than it was worth, and they arnt much better now a few of dads friends left them for the same reason he did recently (tho he wont tell me why lol)

in any case we shall be calling legal services today, hopefully they will arrange something ASAP because they are trying to twist our arms into signing something by the 11th which is stated on the document.
