I am getting only 1MBit/s upload speed, but should be getting 3MBit/s!

I've recently been talked into upgrading from 20 to 30MBit/s by Virgin Media.
One of the main reasons for me going for it, was a promised increase in upload speed, namely from 786kbit/s to 3Mbit/s.

I'm now on 30Mbit/s download speed, but the modem (Virgin Super Hub (Netgear CG3101D) only connects at 1MBit/s and shows that the line is only capable of 2MBit/s.

Virgin advertises 3MBit/s for its 30MBit/s customers here http://shop.virginmedia.com/help/discover-broadband/broadband-speed/upload-speeds.html and yes, I am in an already upgraded area http://shop.virginmedia.com/content/dam/allyours/pdf/schedule_200411.pdf (My postcode is NW3 5NB, Haringey exchange)

I spoke to Virgin who confirmed the problem but said they can't do anything about it.
In my opinion, they really should not be advertising it, if they can't keep their promise. Of course, Virgin did not agree to a refund or to downgrade me again.

Does anyone else have this problem?

(To check, go to http://192.168.0.1 (default = admin / changeme), go to Advanced Settings > Connection. In the table entitled "Primary Upstream Service Flow" you'll find a line saying "Max Traffic Rate". If that says 1111000 bps, you are connected at 1MBit/s only)

Thanks for your feedback!

Unfortunately there's probably not a lot you can do about this, not least because Virgin Media only appears to openly promote download speeds; it's very hard to find uploads mentioned anywhere. They are members of Ofcom's voluntary 2010 speed code of practice, which might be able to help you, except the regulators code only appears to focus on download performance.

Dear Mark,

thank you for your response.
Well, I'm still on the same speed, but I am pleased to say that - after two letters - Virgin agreed to a 25% discount on my monthly bill for the time being, so I'm paying £24 instead of £32 per month on broadband + phone now.

Nice work telemach :) .
