Guernsey Court Overturns £3m of Telecoms Competition Fines

The Royal Court appears to have overturned an earlier decision by the Guernsey Competition & Regulatory Authority (GCRA), which – between 2019 and 2022 – had fined broadband and mobile providers Sure and JT for allegedly breaking competition rules, including by sharing “commercially-sensitive information” and co-ordinating with each other.

Mobile and broadband operator Sure recently confirmed that their roll-out of full fibre (FTTP) broadband on the English Channel Island of Guernsey had now reached 75% of premises (with take-up of 15,000 premises), which puts them on-track to complete the build phase by the end of 2025. Many customers are also being given free speed boosts as part of the upgrade.

The Guernsey Competition & Regulatory Authority (GCRA) has ordered broadband and telecoms operator Sure (Guernsey) Limited to refund a total of £115,360 to customers of their wholesale leased line services, which occurred after the regulator found they had “overcharged” for the service between 1st January 2021 and 31st July 2022.

The States of Guernsey, which governs the English Channel Island of Guernsey (British Crown dependency), yesterday voted to do something extraordinary by temporarily suspending local competition law in order to allow the dominant telecoms and broadband operator, Sure, to acquire Airtel Vodafone. The reward is a £48m deal to deploy 5G services.
