ADSLGuide has spotted something new in Tiscali's Terms & Conditions, a change that turns their once "
unlimited" packages into ones with a 30GB monthly cap.
The key adjustment to their updated T&C's (
HERE) is 'Section 8.4', as per below:
8.4 Tiscali operates a fair usage policy, if you send and receive 30GB or more of data in any calendar month and we believe that your use of the broadband service is adversely affecting our network (or any part of it) or other customers, we may regulate your usage (at our sole discretion). For example, we may give priority to light users over heavy users during peak times. Tiscali reserves the right to terminate your broadband service by providing you with 30 days' notice in writing in the event that you send and receive in excess of 30GB or more data in any calendar month and we believe your use of the broadband service is adversely affecting our network (or any part of it) or our other customers and our regulation of your usage has been ineffective.Unsurprisingly, having previously offered their services on an "unlimited" basis, many existing customers are feeling angry. Not to mention that, despite clearly listing a 2GB cap on one of their broadband packages, they still seem incapable of doing it for all the others.
Having said that, one of our readers (Kommando) reported seeing a newspaper advert for their 2GB's capped 1Mbps package where the words "
Unlimited Access" are used in bold print (2GB cap mentioned in small print).
To make matters worse, the 2GB capped package is promoted as being "
Ideal if you use the Internet to download heavy files, and receive lots of photos, watch high quality video clips and participate in multi-player gaming." - Not what one would associate with a 2GB's cap!
Now to be fair, it's about time Tiscali recognised openly that it could not provide the service advertised. However, the problem is, once again, a serious lack of communication and clear labelling. This causes customers anger and confusion and is something Tiscali have become known for.
