The European Court of Justice has ruled that eBay and other online marketplaces cannot claim exemption from liability for trademark infringements, especially if they are aware of the illegal nature of the sales their sites facilitate. The outcome could impact the MPA's attempts to force a UK ISP, BT, into blocking a piracy website called Newzbin2.
